Mahinda Chintanaya to Promote National Interest through Electoral and Constitutional Reforms

President Mahinda Rajapaksa in his manifesto seeking re-election for the second term of office as President of Sri Lanka has come out with a number of important proposals for Constitutional reform.

As a veteran politician and a representative of the people in Parliament for a period of about 40 years, he has identified the shortcomings of the legislature, and has proposed to

1. Re-establish the Electorate MP system in place of District MPs,

2. Re-introduce a Senate as a part of Parliament,

3. Introduce changes to the Office of the President, and

4. Interlink Village level Jana Sabhas with Regional level Pradeshiya Sabhas, and Provincial level Palath Sabhas with the National level Parliament on the basis of promoting National (Deshapremi) Interests as opposed to Anti-National (Deshadrohi) Interests.

President Mahinda Rajapaksa has defeated LTTE terrorism militarily over the last four years, and is now seeking the mandate of the people, including those in the North who were prevented from voting at the last election for a second term of office. His concern to stabilize the country, and launch an ideological revolution to establish National (Deshapremi) Interest in the National Conciousness is most relevant to rid the country of neo-colonial interference preying upon anti-national sentiments and ethnic susceptibilities.

He has identified the necessary changes to the Constitution to allay the fears of ethnic groups manipulated by foreign powers who have been interfering in the internal affairs of our country. Similar attempts to exploit inter-party rivalries has brought about disaster in many countries of the third world. The attempt at tinkering with the existing Constitution merely to shift power from the President to the Prime Minister, as advocated by opposition factions, is a mere camouflage to play for time and confuse the masses.

Let us examine the proposed reforms in the light of the mistakes of the past sixty years of poor governance.

Governance in Sri Lanka: A Historical Perspective

The Soulbury Constitution, introduced to our country at the time of Independence, comprised two chambers in our national legislature similar to the Westminster Parliamentary System. They were, the Elected House of Representatives with 101 Members of Parliament (MPs), and a Senate comprising 30 nominated Senators. All bills presented in Parliament had to be adopted by both Houses to receive the assent of the Head of Government before becoming Law.

Of the 101 MPs , 95 were elected to represent electorates covering about 80,000 people each, while 6 seats were reserved for unrepresented interests, including ethnic groups. The elected MPs campaigned at elections under registered political parties, or even as independent candidates, and were elected on the basis of first-past-the-post.

The MPs enjoyed the right to dissent with their party if the interests of his electors in his electoral constituency warranted it. Usually, these candidates were well established patrons of the locality who depended on their personal popularity in the electorate to get elected. The expenditure on elections was generally low as the candidate needed little introduction to the people of the area. In any case, they were obliged under the law to divulge the election expenses to the Election Commissioner who had established certain norms. Generally, there was no need for these candidates to amass vast funds for elections, and the elections were relatively free of corruption.

The Senators were nominated by the Elected House from among persons of eminence, such as professionals from commerce, administration, banking, engineering, medicine, agriculture , management, labor trade unions, and religious groups. These Senators were expected to enhance the quality of the Parliamentary debate. However, these noble sentiments, spelled out in the Constitution by the founders, were largely not realized. Sometimes, candidates defeated at elections, and rejected by the people, were nominated to the Senate. Eventually, the Senate was abolished on 1971 by a bill passed in the House of Representatives. The overt reason advanced by the movers of this bill was that the Senate was responsible for delays in passing legislation.

In 1972, the Constitution of the Socialist Republic of Sri Lanka was adopted, doing away with the Senate, and entrusting their executive powers to the Cabinet of Ministers. These included powers to make appointments to state services, grant promotions, implement disciplinary action on state officers, etc. This initiated, and exacerbated, politicization of the entire state service. The Statutory Commissions set up under the Constitution such as the Public Services Commission, the Judicial Services Commission, the Local Government Services Commission, etc. became ineffective as the Cabinet of Ministers exercised total power in the state sector. Thus, the Public Services were politicized, opening the flood gates of corruption in the state sector.

The Organization of Professional Associations (OPA), formed in 1974, had pointed out the anomalies resulting from appointing Elected Members of Parliament to executive portfolios. A number of senior professionals, occupying high posts in the state sector, joined me in this exercise. However, without any nexus with the entrenched power of the state, the voice of the OPA was a feeble cry without impact in the public eye.

To make matters worse, J. R. Jayawardena, after his electoral victory in 1977 by a resounding majority, proceeded to amend the Constitution to make way for the Office of an Executive President, incorporating all the powers of the former Cabinet of Ministers, and requiring District MPs to be elected on a preference vote system. Thus, the accepted principle of an MP as a representative of the electorate was undermined and eliminated.

J. R. Jayawardena appointed himself to the post of the Elected Executive President, and declared all MPs to be District MPs under the amended Constitution. Thereafter, they could be replaced by nominees of the party, following rules applicable to District MPs. He even required all MPs of the government to sign undated letters of resignation, which he kept in his possession so that any deviant could be replaced at his will and command.

This process led to much dissatisfaction among both politicians, and the members of public they had previously represented. The preference vote system killed the very concept of an MP as a representative of the people in a local area. The net effect was an erosion of confidence in the electoral process. It was the party in power that mattered, and the leader of the party virtually became a dictator. Democracy was practiced only in breach of all norms of representation of the electors by the elected, and governance became the rule of the leader, for the leader, by the leader. Even Prime Minister R. Premadasa in the J. R. Jayawardena government felt emasculated, and quipped that he had even less authority than a peon in his office.

Thus, the practice of democracy in the country deteriorated. In the subsequent period the Sinhala youth in the South resorted to violence against a political system they felt was unresponsive to their needs. A major insurrection led by the JVP, in 1987-89 , resulted in the deaths of over 100,000 youth. The internal divisions weakening the Sri Lankan state, now apparent to all, encouraged foreign nations to attain their own agendas by egging on the Tamil youth of the North and East to rebellion; training and deploying them as an instrument for carving out a separate state of Eelam, and bringing Sri Lanka to heel. Using assassination and murder inflicted on their own people, and other Tamil separatist groups, as a weapon to enforce compliance, the LTTE emerged as the dominant separatist terror group. It created a Tamil Diaspora in foreign countries, largely by promoting illegal immigration, as a cornerstone of their strategy to fund and gain international support in the struggle for Eelam. This course of action gave rise to a militant terrorist movement that held Sri Lanka hostage for period of over thirty years.

During this period, Ranil Wickremasinghe, who came to power in 2001 as Prime Minister, came under severe pressure by Norway and other Western powers to compromise with the LTTE, and sign a Cease Fire Agreement (CFA), conceding to terrorists the right to govern a territory amounting to over one third of the land area of the country, and two thirds of its coastal belt. This allowed the LTTE to hold sway over the entire population of the North and East of the country, as a captive enslaved constituency without democratic rights.

President Mahinda Rajapaksa, who was elected to the Presidency in 2005, had to renegotiate the CFA signed by Ranil Wickremasinghe when the LTTE demanded complete separation of the North and East territory as a new nation of Tamil Eelam. This demand was rejected by President Mahinda Rajapaksa who was compelled ultimately to launch a war to liberate the population living in the areas conceded under the CFA to the LTTE, and to reunify the nation. This took three years, incurring the death of almost 60,000 people. Over a million citizens of Sri Lanka living in these areas were liberated from terrorist rule, in 2009.

The Norwegian and other Western powers, who had a variety of vested interests in supporting the LTTE, attempted to save the terrorist leaders in the last stage of the war, to enable them to continue the war, and extend it indefinitely. Having failed in this effort, they are now busy undermining President Mahinda Rajapaksa by threatening to take the military leaders, who saved the country from terrorism, to a UN War Tribunal as war criminals.

This short history identifies the deficiencies in Sri Lanka's democratic system of government in protecting and preserving its National (Deshapremi) Interests, and the consequences of those deficiencies to the nation and its people.

Projected Constitutional Reforms

There have been many Parliamentary Committees who have examined new proposals for Constitutional reform to undo the ill effects of the Executive Presidential system, and the District MP system. So far, none of them have come out with firm proposals. Some have recommended the abolition of Executive Presidency, while others recommended a reduction of its powers and privileges. Some have advocated a return to the Donoughmore system. The Mahinda Chintanaya - Futurist Vision manifesto presented by President Mahinda Rajapaksa expects to take up these matters with all political parties in Parliament, to make a final decision to bring about desirable changes in the National Interest.

The manifesto points out the need for unity in operation of the local government system. It has proposed the formation of Gam Sabha in every Grama Sevaka division in order to integrate the village polity, and promote their participation in village level activities devoid of political differences. This is expected to eliminate corruption and misuse of funds spent on village-level development.

The Gam Sabhas are to elect representatives to the Pradeshiya Sabhas, or Urban/Municipal Councils. Such representatives would have no political leanings, and the representatives of the Gam Sabha would be elected to the Pradeshiya Sabha on the basis of merit rather than political affiliation or agenda. In support of this concept, President Mahinda Rajapaksa has cited the Indian example of the Panchayat system.

The Provincial Council system introduced in the 13th Amendment to the National Constitution will be reviewed in consultation with all interested stake-holding parties.

The Senate as a part Parliament is to be revived. President Mahinda Rajapaksa has appealed to the nation to adopt a national approach in politics, and to join his government to work in the best interest of the nation as a whole. He has already brought into the government many MPs from opposition political parties, and has offered them Ministerial portfolios, demonstrating his willingness to be pragmatic and realistic. He has appealed to them to be patriotic, rather than be manipulated by foreign interests for personal gain.

In this connection, I note that the emphasis of President Mahinda Rajapaksa on National (Deshapremi) Interest parallels the advocacy of National Interest Sectors linking village level government to the highest level of governance, as an alternative to political parties, that was proposed in the National Solidarity Charter in 1995 by a group of professionals in the Organization of Professional Associations (OPA). The current trend in forming political parties based on class, caste, religion and ethnicity has been the curse of Sri Lankan politics. I hope that President Mahinda Rajapaksa will consider National Interest based on Professions associated with the Economic and Social Sectors of the country, as proposed in the National Solidarity Charter (1995), as an alternative means of implementing the Mahinda Chinthanaya - Futurist Vision manifesto. In this way, those who would disregard National (Deshapremi) Interest can easily isolated from the national ethos as Anti-Nationals (Desadrohis), and be prevented from acquiring the power to undermine and degrade the nation.

The National Interest Sectors suggested in the National Solidarity Charter (1995) are:

1. The Professional Sector, comprising existing professional bodies and new associations and institutions to be recognized in the future when new professions emerge and are recognized,

2. The Religious Sector, comprising representatives Buddhist, Christian, Hindu and Islamic bodies,

3. The Consumer Sector, comprising consumer societies representing different consumer groups such as food, education, health, finance, security, social welfare, etc.

4. The Trade Union Sector, comprising major labor trade unions recognizes by the Commissioner of labor, and

5. The Business Sector, comprising Trade Chambers, Investment Chambers, Finance Chambers, Consultancy Chambers, etc.

National Interest Sector Groups at Village level could elect their representatives to the Regional Council Pradeshiya Sabhas, who in turn could elect their representatives to Provincial Council Palath Sabhas. An Electoral College of Representatives composed of Village-Level , Regional-Level and Province-Level leaders could elect electoral representatives to the National Parliament.

Conclusion

The far-sighted reforms proposed in the Mahinda Chintanaya - Futurist Vision to promote National (Deshapremi) Interests while discouraging Anti-National (Deshadrohi) Interests, by permanently embedding Deshapremi Ideology in the National Conciousness, is necessary to focus and sustain the nation's efforts on National Development in the future.

This will bring to a permanent end the adversarial jockeying for power that has plagued Sri Lankan politics in the 62 years since the dawn of independence in 1948.

STF finds arms cache, Fonseka’s posters at temple
The Special Task Force personnel recovered 54 hand grenades and two T-56 rifles from a temple in Colombo yesterday. Military spokesman Brigadier Udaya Nanayakkara confirmed that the grenades and assault rifles were recovered from Bodhirajarama Temple in Maligawatte last evening.

Reports said several posters and propaganda material in support of New Democratic Front Presidential candidate Sarath Fonseka too were found during the raid.

It is alleged that these military items were aimed at using to unleash violence by the JVP-UNP backed main opposition to unleash violence on the eve of the Presidential elections. Parliamentarian Wimal Weerawansa alleged that the chief incumbent of the temple. Ven. Uwathenne Sumana thero who is an active supporter of the United National Party is publicly campaigning for Fonseka’s candidature.

A major disaster was averted due to the timely recovery of weapons as the Opposition is making desperate attempts to initiate such acts to put the blame and discredit the government, Weerawansa said.

A special Police team is making investigations to find whether yesterday’s recovery has any link to the grenade attack on the residence of Tiran Alles.

A: That’s a good question. I’ll tell you about them. Any one of these people being on Fonseka’s side is enough for us not to vote for him.
First, we have the man himself, Fonseka, who’s gone and said that minorities have no rights.
Then, it’s Ranil. He’s the man who said that Islam is spread by the sword at a conference at the BMICH at a book launching several months ago.

Next is Sarath Silva, the former Chief Justice. He’s the one who wanted to put a ban on Azan calling.
Because of a problem between two mosques, he gave an unfair decision that affects all mosques and religious institutions around the country.

Then there’s Wijedasa Rajapaksha. After he got some deshabhimana title from priests, he straightaway went and handed a document to parliament asking to put an end to slaughtering of animals. Slaughtering animals is a basic right of a Muslim.

So, Fonseka and the people behind him are not going to hesitate to destroy the minorities if they get a chance. That is why Muslims need to think very carefully when they vote this time.
You don’t have to do much, just look at ads that Fonseka has been putting up. There is no reference to minorities.

Gonseka camp assumed they automatically get muslim votes and tamil votes which are usually with UNP. In fact UNP vote base includes 75% of minority votes. So they targeted sinhala voters who were amazed by war victory, UNP turned voters to JHU and nationalistic voters who give priority to corruption. But it looks like Gonseka camp have miserably failed. If it happened that "allapu aththath na, paya gahapu aththath na" then MR may get >60%.

The Police Special Task Force carried out a raid on Sri Bodhirajaramaya Temple in Maligawatta last night and discovered a large quantity of weapons along with a cyanide capsule and posters of presidential candidate Sarath Fonseka.
Commandant of STF, Deputy Inspector General (DIG), K M L Sarathchandra told The Nation that the arms cache was recovered from the bedroom of the Chief Monk of the temple, Ven. Uvathenne Sumana Thera.
“Ven. Sumana Thera along with another monk and six civilians of whom two were Tamils, were arrested with the weapons. Nearly 100 rubber seals and 10,000 posters of Sarath Fonseka were recovered,” Sarathchandra said.

He also said that it was too early to comment as to whether the suspects had any links with the Liberation Tigers of Tamil Eelam (LTTE) although the possession of a cyanide capsule indicated such a connection.
“The people of the locality had surrounded the temple and were demanding that the head monk be handed over to them as alleging that he was a drug peddler,” he added.

Police spokesperson Senior Superintendent of Police (SSP),I.M. Karunarathna confirmed that two T-56 rifles, 56 grenades, and 762 rounds of ammunition, two smoke grenades, six T- 56 magazines, forty-one 9 mm rounds, 700 micro pistol bullets and Rs.200,000 in cash were found at the scene.

The police have received information that around 300,000 fake ballot papers are circulating around the country and sought public support to crack down on its distribution.


Senior DIG of the police elections unit Gamini Navaratna, speaking to Daily Mirror online, said that the revalation came following the detection of 21700 fake ballot papers this week.


He said that the police are now trying to identify where the nearly 300,000 fake ballot papers are being distributed.


The police had this week detected two ballot boxes in Pettah filled with 21700 fake ballot papers which were being prepared to be transported to Puttalam.

For thousands of Sri Lankan Tamils there is only one issue that really matters in next week's presidential election - their rehabilitation after months in government-run camps.

They were kept in these camps after they were displaced in the final bloody phase of Sri Lanka's 26-year civil war, which ended in the defeat of Tamil Tiger rebels fighting for a separate homeland.

Many have now been released from the camps in the northern Vavuniya district and resettled. But they say they lack the basic facilities to rebuild their lives.

"My house was completely destroyed. I was given five tin sheets and 25,000 rupees ($220) in cash. I lost my cattle. There are no jobs here. It is difficult for me to support six members of my family," says Kandhan, who lives in the Mullaittivu district.

Kandhan - who before his internment earned a living by buying and selling scrap metal - says that his request to restart his trade has yet to be approved.

Numerous small shopkeepers wanting to restart their businesses face the same predicament.

The government had until recently resisted international calls to speed up the release and rehabilitation of those held in camps.

It said that it needed more time to rebuild infrastructure and complete de-mining.

But recently the authorities finally allowed people from villages to the west of Sri Lanka's key A9 road in the north to go back to their ancestral homes.

Each family was provided with a small sum of money and dry rations for six months.

They were also equipped with bamboo sticks and tin sheets to set up temporary shelters.

Officials say loans are given through banks to allow people to start new ventures, particularly farming.

But locals say their farmland is full of wild shrubs now and it will take many months of hard labour before the fields can once again become productive.

Some hospitals and schools in these areas have re-opened. Mobile phone connections are also working. But public transport between the villages and the nearest big towns is inadequate.

"Many houses are partly or completely destroyed. People are putting up tents in the fields and living there. There is a shortage of water. There is no electricity in the villages," says one government official who frequently goes to these areas.

'Difficult life'

But the minister in charge of re-settlement, Rizath Bathiyutheen, dismisses these complaints.

"No other country would have resettled so many people in such a short span of time," he said.

"We have repaired public buildings like schools and government offices, improved road conditions and de-silted some wells before sending people back to their homes.

"There is a shortage of water in many areas in the region and we are trying to sort out this problem. For years, many of the villages in these areas never had electricity. It may take sometime to provide it."

The government has since December been granting permission to the camp inmates to go out and stay with their relatives.

Fifty-eight-year-old Ramalambikai used the scheme to come out of the camp where she was detained. Now she is living with her relatives in Mallavi.

"The government has not cleared our area for resettlement," she said.

"My family still lives in the camps. I am happy to come out. Here life is difficult, groceries are very expensive. But we are able to cook and eat peacefully."

'Suffering and pain'

Some are struggling to come out of the shock of the war and prolonged internment in the camps.

"I lost my father in the war," says another woman.

"My 10-year-old daughter was injured in a shell attack. My sister lost her two-year-old daughter and her husband in the war.

"Because of this suffering and pain we didn't want to come back to this place. But we have nowhere to go."

Local non-governmental organisations (NGOs) claim that they can provide more assistance to the needy if the government gives them access to northern areas.

The authorities have now given permission to international aid agencies like the World Food Programme, the International Organisation of Migrants and the UN High Commission for Refugees.

"We have asked the NGOs to provide us with proposals regarding what they intend to do. We want to define the areas of work before giving them permission. We don't want a duplication of work," says Mullaitivu government agent Emelda Sukumar.

Even as the revised government target for re-settling all displaced Tamils before 31 January fast approaches, there is no word yet on when it will take place in other camps adjoining the towns of Kilinochchi and Mullaittivu.

These places bore the brunt of the fighting and for the moment senior officials in these towns continue to operate from Vavuniya.

But for the 80,000 internally displaced people who still remain in camps, campaigning in Colombo seems to be very far away.

Minister of Education Susil Premjayath said the opposition candidate had announced his decision to punish military officers. General Sarath Fonseka is making such statements before assuming power, insulting the war heroes who have been engaged in the liberation of the country.

As such, Minister Premjayanth queried as to what the situation would be if Fonseka assumed power.

He made these statements while addressing a media conference held at the Mahaweli Center today (23).

The Minister pointed out that Presidential candidate Sarath Fonseka has warned that military officers who are expressing views on TV channels that they will be brought before the war tribunal and they would be penalized after the 26th of January. Sarath Fonseka also warned them to immediately stop these activities.

Minister stated that war heroes, who led their brigades in the battle zone, discharging a valuable task in the victory of the humanitarian operations, appeared on TV channels to educate the public the real victory of the humanitarian operations. They are none other than Major Generals Kamal Guneratne, Shavendra Silva, Chargi Gallage and Prasanna Silva. However, what Sarath Fonseka has said was that they would be immediately produced before the war tribunal.

Jan 23, Colombo: As the much heated campaign for the presidential election coming to an end at midnight today the two main candidates are in a last-minute frenzy to win the voters.

Both incumbent president Mahinda Rajapaksa and common opposition candidate retired General Sarath Fonseka will address three rallies each today.

President Rajapaksa will address rallies at Debarawewa in Tissamaharama at 10:00 a.m., Hiniduma in Galle at 3:00 p.m. and Kesbewa, Piliyandala at 5:00 p.m.

General Fonseka will address rallies in Galle, Negombo, and Maradana.

All election campaigning are to end midnight today. The police have informed the party activists to stop canvassing and remove decorations from midnight today, IGP Mahinda Balasuriya said. All cutouts, banners, and decorations in a radius of 500 meters from the polling booths have to be removed.

Jan 23, Colombo: Sri Lanka President Mahinda Rajapaksa requested the public to not let the power of gun to suppress the franchise on the Election Day and unite together to discard the agreement between the Tamil National Alliance and the common opposition candidate, General Sarath Fonseka.

Addressing the first of the three public rallies at Debarawewa in Tissamaharama today, on the last day of campaigning, the President said he is confident of an unprecedented victory at the presidential election on next Tuesday (26).

The President recalled how the opposition leader signed a ceasefire agreement with the terrorists to divide the country and pointed out that the opposition alliance has similarly agreed with the TNA to betray the country.

Addressing the issues of the tenant farmers in the area, President Rajapaksa said a bill will be passed in the parliament with immediate effect to look into the grievances. He promised to continue the subsidy for the farmers despite the pressures to curtail the subsidies.

He said the government's development work will focus on improving the local economy. "The national economy did not collapse even amidst the global economic down turn due to the pragmatic economic policies implement by the government," he said.

The president assured that he will never safeguard the persons who are responsible for corruptions, frauds, and malpractices.

President Rajapaksa addressing a rally at Hiniduma in Galle said Sri Lanka has become free country with a significant economic growth. His aim is to create a society conducive to the younger generation of the country.

The final rally of the ruling party is now being held at the Somaweera Chandrasiri grounds in Kesbewa . The senior leaders of the UPFA are participating in the rally in progress along with the Veteran sportswomen Sriyani Kulawansa and Susanthika Jayasinghe.

All campaigning for the 2010 presidential election are to end by midnight today according to police orders.

Opposition supporter arrested with weapons in Sri Lanka capital

Jan 23, Colombo: Sri Lanka Police Special Task Force (STF) personnel have arrested a supporter of the common opposition presidential candidate General Sarath Fonseka with two T-56 riffles and 54 hand grenades around 7 PM today (Jan 23).

According to the STF sources, the items have been found inside Bodhirukkaramaya, a Buddhist temple at Maligawatta, in the capital Colombo.

Uwathanne Sumana , a Buddhist monk and a strong supporter of the opposition candidate has been arrested by the STF, said the sources.

Government authorities believe that the finding reveals a plot by the opposition to create violence and put the blame on the government during the election scheduled on the 26th of January.

Investigations are continuing, the police said.

Sarath Fonseka, in trying to counter Rajapaksa claiming credit for bringing an end to terrorism has throughout his campaign been touting slogans of nepotism and corruption. But this does not appear to have had any significant impact with the southerner. People are simply happy to be able to walk freely without living in fear of bomb explosions and devastating suicide attacks. And this appears to be the basis for high spirits rampant throughout the southern belt, with the coastal stretch along the Galle Road vibrant with coloured flags, posters and cutouts – all of course, in total violation of election laws.

The poster war on the walls between the two main contenders, both this time, sons of the south, is indicative of the closely drawn battle lines at Tuesday’s presidential poll.
However, it was various mug shots of President Mahinda Rajapaksa that were the most visible – gleaming but garish, as they grin at vehicles and passersby. The dominant colours of blue and red among the election decorations in most areas in the south, especially the Hambantota District, which is also the hometown of President Mahinda Rajapaksa, showed his support base in the area.

General Fonseka’s presence on the other hand, appeared dismal with only a few decorations, even fewer election offices and a few scattered posters. The General’s presence was not hugely visible even in his hometown Ambalangoda.

Matara District Parliamentarian and General Fonseka’s Co-media Spokesperson, Mangala Samaraweera had a story to tell. He however insisted “General Fonseka’s campaign in the villages is extremely upbeat and the UNP rank and file who have been in hibernation seem to have been energized.”

He also observed that there was no political campaign for President Rajapaksa in the south, especially at the ground level since the SLFP organisers were not engaged in their normal routine political activities. What we witnessed was to the contrary. The President does appear to enjoy a significant support base, with or without the aid of his grass-root level organisers — with a cross section of people in the south saying that President Rajapaksa would emerge victorious at the election.

Chaminda, Nayanananda and Nadun from the Devinuwara three-wheeler stand, were very certain as to whom they would cast their votes. Quite openly, they said their votes would be for the President for ending the war. “Although General Fonseka was in the army for 40 years he could not defeat the LTTE until President Rajapaksa gave the necessary leadership,” they said.

Their comments resonated with most of the people whom The Sunday Leader spoke to in the Southern Province.

“It is more important for us to be able to move freely now – without fear for our lives,” Chandrasiri and Karunathileka from Ambalantota said.

TNA honours slain LTTE Tigers at opposition rally in Jaffna

ColomboPage News Desk, Sri Lanka.

Jan 23, Jaffna: An election rally organised in support of the common opposition presidential candidate General Sarath Fonseka this evening in Jaffna, observed 2- minute silence to honour the Tamil Tigers killed during terrorist activities.

The meeting which is still in progress at Sattadar Kovil, Nallur has been organised by Tamil National Alliance (TNA), which was once considered as an LTTE proxy party.

According to the sources in Jaffna, TNA leader R. Sampanthan and TNA parliamentarians, Suresh Premachandran, Selvam Adaikalanathan Solomon Cyril, K Thureiratnasingham and Padmini Sidambaram are participating in the event.

The meeting started at 4:30 p.m. with the participation of about 500 people. At the outset the organizers blamed the EPDP, a Tamil political party in the ruling coalition, for the low turnout for the meeting saying that the EPDP has threatened their supporters.

The common opposition has been accused of entering into an agreement with the TNA in return of their support.

The other thing is that winning or winning margin is not the issue here. Even if MR win by 95% majority then still they would have used the eveidence to make it 95.5%.

Complete demolition of current donkey Mangala/Ranil/SF type politics is necessary.

Even if 50 sicentific polls say that MR will win by 15% majority there is a low probability that MR can loose by 5% (95% confidence interval-even though unlikely)

With Nation, one should not take risks. It would have been ok if it were Sirima and Dudley.

This certainty is that an almost unchallengeable juggernaut Rajapaksa Presidency has been shaken to its very marrow by the range and forcefulness of the challenges mounted against it. I am not talking here only of political challenges but also of reenergized public opinion which is now reflecting issues and questions concerning our political systems and governance processes which would have seemed quite unthinkable just a few months back.

Despite the vicious mud slinging and the upsurge in electoral violence, this is perhaps a most positive feature regarding the upcoming elections. And notwithstanding persisting cynicism regarding the virtually overnight transformation of a hardline army commander to a liberal unifier of a once fractured opposition as its common candidate, I am, (as a citizen of this country who will insist on casting my vote Tuesday hence), insensibly grateful for this interjection of a strong counter into a hitherto cowed and subjugated polity.

Electoral paradoxes and government hypocrisy

There is, after all, little quarrel with the proposition that in the absence of a strong counter, this month's election would have been a given for the incumbent President. We would see continued disregard of constitutional safeguards ensuring principled governance and further extreme repression of the media. Lofty Presidential pronouncements that there are no more minorities or a majority in Sri Lanka would be belied by (to mention one existing example) the sentencing of an ethnic Tamil to twenty years imprisonment primarily for the sin of writing and publishing commentaries critical of government policy in the war theatre. It took a strongly contested election to release JS Tissainayagam in bail and to 'resettle" thousands of internally displaced persons living in the mud on welfare camps. What better message these acts may have conveyed if they had been engaged in voluntarily by the government without being virtually bulldozed into so doing by opposition demands?

Contempt for the law and for the Constitution

But it is the contempt with which the law and the Constitution is regarded by the current administration which is quite remarkable. The Commissioner of Elections as well as the Supreme Court has been rendered mute witnesses to the total flouting of election laws. No doubt, the difficulties that the Commissioner of Elections finds himself in, given the over and covert intimidation that his Department is subjected to and given also that the police is firmly under the political thumb of the government, are enormous.

However, there is little point in engaging in vain dramatics by withdrawing the Competent Authority on the state media and by threatening to step down post elections. Instead, at the very minimum, abuses of state resources must be comprehensively documented by the Commissioner's Department and the results thereof must be publicly and periodically released. These are important factors that should influence the public vote surely? In what manner is the duty of the Commissioner of Elections satisfied in this context?

In addition, we have unnamed spokesmen from the Attorney General's Department who have claimed that the delay in the President appointing the nominated members of the Constitutional Council is due to all the nominations not being sent in. There is perhaps a very good reason as to why this spokesman remained anonymous for this blatant falsehood is contradicted by court records themselves that show that, in fact, the requisite nominations were all sent as per constitutional procedure with the last and most contentious nomination being by a majority of the minority parties as constitutionally permitted.

It is this most blatant mockery of the law that is troubling even more than farcical media advertisements which are replete with falsehoods regarding the accomplishments of the incumbent's term. One of the more absurd claims by the way is that the Southern expressway and the Katunayake expressway have been completed. The reality is not only that these expressways are far from being completed but that lives have been lost due to corrupt construction practices.

Influencing the 'floating voter'

So to give the unknown devil (or angel) his proper due, the fact that General Sarath Fonseka has provided a strong counter force to an exceedingly unhealthy juggernaut Presidency needs to be acknowledged. This is, of course, notwithstanding the presence on his stage of characters quite singularly bereft of democratic credentials such as former Chief Justice Sarath Silva who has resoundingly put egg on the faces of misguided editorialists and columnists who were foolish enough to predict that he would not enter politics following retirement. Regardless, the fact that the common candidate lacks the dangerously manipulative political base of the incumbent, (let alone those distasteful family connections), taken together with the myriad of opposition forces backing him, may well suffice to sway (albeit uneasily) the vote in the minds of those comprising the floating voter base in this country.

This is not to say of course, that all the evils that bedevil Sri Lanka's governance systems will miraculously disappear into thin air come January 26th 2010. Whatever may be the outcome of the elections, this country will certainly face serious trials and tribulations in the months ahead. While the focus may be on the Presidential polls now, this year's parliamentary polls to be held later, centering on unpopular and corrupt ministers and local level politicians, hold out a completely different picture. If the opposition momentum continues beyond this Tuesday's election, we will perhaps witness some unique political scenarios developing in the near future. These are some slight positive factors in today's largely dismal and degenerate electoral culture.

Learning from the public mood

We can also hope that Mahinda Rajapaksa, once an appealing human rights activist and certainly one of the more likeable among our political leaders, has learnt from the critical public mood of past months that extreme corruption, family rule, misgovernance and repression of dissent cannot be excused under the cover of winning the war. We can hope that he would be wary of propagandists in the state or private media operated by his sycophants adept at changing their tune according to which way the political winds blow. We can also hope that whoever wins or loses on Tuesday, the Executive Presidency will be stripped of its obnoxious features and the Constitution adhered to in spirit as well as form.
If not, it will certainly be a most profound pity for this country and her people

It depends on the definition of what you mean by locked up. There are many places in the world where peoples movement are being curtailed. But when you say locked up, it is more like a cell. Non of the refugees were locked up in cells. Still bringing up bullshit internment camp when most of the people in those have already moved on to there original places of living.
Remember, there are other people in SL. It is not all about Tamils. Stop bitching like women.

Armed Force Commanders promoted to next higher ranks

His Excellency Mahinda Rajapaksa, President of Sri Lanka and Commander in Chief of the Armed Forces has granted promotions for the commanders of Army, Navy and Air Force who have been instrumental in winning the historic battle against LTTE terrorism in Sri Lanka.

Accordingly, Army Chief Sarath Fonseka has been promoted to the rank of General,
Navy Chief Wasantha Karannagoda has been promoted to the rank of Admiral and Air Force Chief Roshan Goonathilake has been promoted to the rank of Air Chief Marshal.
