With the results of the 2010 General election published, the governing United People's Freedom alliance (UPFA) has recorded an unprecedented victory in recent election history. When the results of the two annulled electorates are announced, and the national list allocations are completed, the UPFA is expected to get a massive 144-146 seats out of 225.

Epic victoryThe UPFA victory eclipses the previous record for the highest number of seats obtained by a winning party (ie, the United National Party's 125 seats in 1989) under the proportional representation (PR) system of 1978. It also debunks the myth that strong governments cannot be formed under the PR system.
The number of seats obtained by the UPFA does not reflect the full grandeur of the victory. They carried 135 of 158 electorates (similar to the 5/6 victory of UNP in 1977). Their winning percentage of 60.4%, and margin of 1.8 million (against the aggregates of all other parties), are unprecedented as well. One might complain that the turnout was comparatively low. However this was to be expected after the presidential election, and compared to other democracies in the world, 55% is by no means a low turnout. Moreover, if one looks at the results carefully, it is apparent at roughly similar numbers of government and opposition supporters stayed home on election day, compared to the Presidential Election on January 26, 2010.
The victorious UPFA
As requested by the president, the people have given the UPFA a strong Electroral Mandate, thereby ensuring 6 more years of stable rule. The leaders of the government have to realize that this is the last election they can market the war victory for votes. Other issues will take center stage in subsequent elections:
1. The economy- The government will hopefully be able to reap in the benefits of the infrastructure developments and economic growth over the next six years. The peace dividend should filter down to the masses, who richly deserve it.
2. Corruption and thuggery- The UPFA voters themselves have voted out some of the corrupt and inefficient ministers of the previous government. However, some errant characters who are locally popular have been elected. The government should rein in these MPs, and project the image of a true people's government. With a strong government, the president has the luxury of appointing a small cabinet. The choosing of suitable and efficient ministers, as well as a capable prime minister, will be very important for the future of the UPFA government.
3. The Eelam struggle- Though the armed struggle was extinguished last year, the diaspora Tamils backed by western powers still plot and scheme to divide the island. Whilst countering these threats externally, the government must strive to eliminate the root cause of the problem through ethnic integration (ie, via strategic re-colonization, increasing contact and empathy between communities, and economic development).
UNP: A toothless opposition.
The UNP hurtled towards it's worst defeat since the PR system was introduced, and is expected to win only 58-60 seats. They won only 9 electorates, reminiscent of their rout at the hands of the SLFP in 1956. If the UNP is to make a comeback, a total makeover is necessary. It is unlikely that Ranil Wickremsinghe could ever lead the UNP to victory at an election. By not electing some of his cronies (Vajira Abeywardane, Sagala Rathnayake), the UNP voters have also sent their leadership message. Moreover, the so called 'Kepuwath Kola' generation of rural UNP-er are dying out (literally) leaving only the Colombo-centric supporters. Unless new leaders such as Sajith Premadasa, or Dayasiri Jayasekara, are given priority and leadership oppotunities, Sri Lanka risks becoming a one party state.
JVP: Saving face
Many of the readers may disagree, but the JVP has to a certain degree saved-face at this election. They are likely to win 7 seats, which is far better than the 1-3 they were initially projected to win. It seems, apart from their own hardcore cadre, about 200,000 Fonseka sympathizers voted for them as well. Thus, they have saved themselves from political irrelevance for another six years. Until such time their trade and student unions are dismantled, the JVP will continue to play a role in Sri Lanka's political landscape.
ITAK/TNA : The last throw of the dice..
Without any LTTE firepower to back them up, the ITAK(TNA)'s seats in the North and East were reduced from 22 to 14. Moreover, they polled less than 50% in the Tamil heartland of Jaffna, and less than 40% in the other districts they contested. In fac,t with 4000 or so more votes, the UPFA could have wrested victory from the ITAK in the Vanni and Batticaloa districts. With the new census to be conducted in 2011, the number of seats allocated to the North is expected to drop by about 4 (Jaffna -3, Vanni- 1), whilst Battticaloa would likely lose 1 seat as well. Therefore, coupled to the moderating influence of ethnic integration in future years, the influence of TNA is likely to be further diluted in subsequent elections. Therefore, they will be hellbent in their effort to preserve their mono-ethnic fiefdom, by agitating for a federal solution. We call upon the government to frustrate their communal and separatist designs at every turn.
Conclusion
The results of this election will greatly influence the destiny of Sri Lanka in the coming years. If the government lives up to it's great potential, the Silent Revolution of 2010 will far outshine the achievements of the 1956 and 1977 electoral revolutions. Let us hope that all goes well for our motherland, and that our children one day will proudly call themselves "Dedahas Dahaye' Daruwo!"

7. The authors say it is not a systematic conspiracy as such, but a wrong set of beliefs that has taken hold in the country. They believe that the US Govt should limit the size banks can grow to less than $100 billion by breaking up these super banks and them imposing strict oversight. Then they can be allowed to fail if they need to, without causing a global financial meltdown.

Personally, I found this interview fascinating as I am very concerned about the immense debt load carried by the US Govt. I want to know how to diversify my investments and income, perhaps through real estate and foreign holdings, to survive any economic collapse that could come in the future. We have had so many financial skullduggeries in the US, that trusting professional financial advisers is a pretty dicey business.
This is also the concern of many TEA Party members. Unfortunately, the TEA Party movement is being exploited by the Republican Party which largely created these problems during George Bush's two terms as president, and is now keen to exploit any issue to displace the Democrats and propel themselves into power.

CHENNAI: Slain LTTE chief V Prabhakaran's ailing mother, Parvati, who arrived here last night from Malaysia was deported immediately as the Central government did not give permission for her stay in India, police said.
Parvati, who was to be admitted to a hospital here for treatment, arrived from Kuala Lumpur but policemen did not permit her to alight from the aircraft, officials said.
Elaborate security arrangements were made and suburban police commissioner, Jangid, was himself present to oversee matters as there was a crowd of over 150 persons including MDMK general secretary Vaiko and Tamil nationalist movement leader P Nedumaran, both vocal supporters of the proscribed LTTE, at the airport.
On May 18, 2009, the Sri Lankan government announced Prabhakaran had been killed while trying to escape advancing army troops in the north of the country and said his parents were found inside a camp for displaced people.
His father Tiruvekkdam Velupilli died this January.

RAIPUR: Authorities in Chhattisgarh are keen to use unmanned aerial vehicles (UAVs) in Maoist-dominated pockets in the wake of the massacre of 75 security personnel, official sources said.
"A report of the successful night trial of the US-made UAV in Bastar forests this week is to be sent to the central government with a request to allow security forces to use the UAV facility," a police source here told IANS.
According to officials, a UAV weighing 10 kg was tested in jungle areas near the Counter Terrorism and Jungle Warfare College in Kanker district, some 150 km south of here.
Kanker and four other districts form the Bastar region, spread over 40,000 sq km. Bastar has been a Maoist stronghold since the late 1980s.
"The trial for UAV was intended to evaluate its efficacy in providing real-time intelligence and detection capability during low illumination and at night in thickly forested stretches," the police source said.
"It is up to the central government to take a decision on whether security men in the jungle terrain should be equipped with UAV facility."
Seventy-five Central Reserve Police Force personnel and a Chhattisgarh policeman were killed by Maoists in the forests of Dantewada district in Bastar region April 6.
India opposes sanctions against Iran at BRIC, IBSA summits
Brasilia, April 17 (IANS) India opposed a drive by western countries to impose new sanctions against Iran at the recently concluded IBSA and BRIC summits here.
There was a free exchange of views on Iran, where the Indian prime minister opposed sanctions and advocated dialogue to resolve the Iranian issue, Commerce and Industry Minister Anand Sharma told journalists Saturday. Iran needs to be engaged, he said.
At the BRIC summit held in Brasilia Friday, leaders of Brazil, Russia, India and China (BRIC) agreed that the sanctions against Tehran will be counter productive and advocated diplomacy to resolve the Iranian nuclear crisis.
IBSA countries are India, Brazil and South Africa.

Michael Lewis on Wall Street

The Big Short is a good story and provides some illuminating lessons about Wall Street. Lewis doesn’t really come out and say what he thinks about Wall Street; he lets his characters do that for him. But in his recent interview with Christopher Lydon, he really lets loose. Here are some direct quotations.
Lewis: “The people who were responsible for orchestrating the crisis, because they’re on top and they’re in the middle of it, they’re the only ones who are sort of fluent in the language of it. I mean, who’s to question Tim Geithner, the secretary of the treasury, about this or that, because he’s the only with the information . . . even though he is clearly culpable in what happened.”
Lydon: “Not to mention Larry Summers and Bob Rubin and all the other architects of the deregulation. They’re still calling the shots in a new administration after a change of party management. It’s unreal.”
Lewis: “It is unreal, because basically all of the people you mentioned all swallowed a general view of Wall Street, which was that it was a useful and worthy master class, that these people basically knew what they were doing and should be left to do whatever they wanted to do. And they were totally wrong about that. Not only did they not know what they were doing, but the consequences of not knowing what they were doing were catastrophic for the rest of us. It was not just not useful; it was destructive. We live in a society where the people who have squandered the most wealth have been paying themselves the most, and failure has been rewarded in the most spectacular ways, and instead of saying we really should just wipe out the system and start fresh in some way, there is a sort of instinct to just tinker with what exists and not fiddle with the structure. And I don’t know if that’s going to work. When you look at what Alan Greenspan did, or what Larry Summers did, or what Bob Rubin did, there are individual mistakes they made, like for example not regulating the credit default swap market, preventing that from happening. But the broader problem is just the air they breathe. The broader problem is just the sense they all seem to have that what’s good for Goldman Sachs is good for America.”

Lewis: “The question is how does Washington move away from those institutions and make decisions that are in the public interest without regard for the welfare of these institutions. It’s a hard question because . . . this is the problem. Essentially the public and their representatives have been buffaloed into thinking that this subject — financial regulation, structure of Wall Street — is too complicated for amateurs. That the only people who are qualified to pronounce on this are people who are in it. And there are very very few people who aren’t in it in some way who have the nerve to stand up and fight it. . . .
“The elected representatives look at the financial system, I’m sure, and they think, it’s too complicated for me to understand, I’m going to be quickly exposed as a know-nothing if I take the lead on regulation, and in the bargain I’m going to miss out on all these campaign contributions from the financial industry because I’ll alienate them.”

Lewis, on Barack Obama: “He’s been captured by his banker, just like the ordinary American’s captured by their stockbroker. He’s been buffaloed by the complexity of it all, he doesn’t have time to sort it out for himself, and he has to trust the people who seem to know. The alternative is for him to set off on his own in a quixotic quest to reform the financial system without having any experience of the system. It’s sort of like the presidential version of regulatory capture, that he is at the mercy of the people who really don’t have probably his long-term best interests at heart but who seem to know what they’re talking about.”

ML: The broader thing about all these characters to me is that their attitudes, their approach to life, their ability to hear the data, was something that was marginalized in the system itself. They didn’t belong, none of them belonged, and they should have belonged. What is it about the system that doesn’t want them as a part of it? And it’s terrifying when all the people who were wrong are in charge, and all the people who are right are on the outside.
CL: It sure is. To me there’s a direct analogy to be drawn with the war in Iraq. The Congress signed off “oh well, he must know something.” Tony Blair embraced it. The media by and large encouraged it. A very, very few people said “are you kidding?” And yet the ones that warned against the war in Iraq got the same prize that your guys got for warning of the meltdown.
ML: Yes. Ostracisim.
CL: Exactly, and they’re still ostracized.
ML: It’s funny. There is an analogy. And the analogy is there’s a kind of a blind faith in leadership that is the result in both cases of ordinary people feeling they can’t evaluate the situation because it’s too complicated. The financial system got so complicated, and the complexity became opacity. When Alan Greenspan stands up and says something, no one understands what he’s saying. But they think that’s a good thing, because it’s all so complicated they shouldn’t understand what he’s saying. And the fact is they should. The fact is, if things aren’t being explained in a way you and I can understand them, it should be a bad sign, not a good sign. But the complexity was turned on its head. It was used as a way to mask bad things that were happening.
There’s a joke in it all. The joke is that the financial system, and there are analogies to the political system, but the financial system wanted to do something it really shouldn’t do. It wanted to make lots of loans that it shouldn’t make. They created all this risk that was going to blow up the system. In order to do that they needed to disguise the risk. So to disguise the risk it used all this complexity, which served as a smokescreen. And the joke is that it ended up disguising the risk from itself. That the very people who created the smokescreen were engulfed in it, and they couldn’t parse the system they created.

JK: One of the parallels between the financial crisis and the Iraq War is that despite all the things that have gone wrong we still have largely the same people. We see the same people on TV, the same people in Congress telling us how we should understand the crisis and what we should do next. And during the Bush Administration people were saying, “Why didn’t anyone get fired for the Iraq War?” And the same question applies now: Why hasn’t anyone been fired because of the financial crisis?
I think there’s another parallel as well, which is that, again, the cover-up that’s going on by Wall Street today is this idea that the financial crisis was an accident, that it was a lot of people making mistakes—it was lenders making bad lending decisions, and homebuyers making bad borrowing decisions, and rating agencies making bad decisions when they rated these toxic securities, and unbelievably these investment banks holding onto their own toxic assets, and then regulators being asleep at the switch.
CL: Perfect storm.
JK: Yes, exactly. It’s the perfect storm theory. And what they’re trying to do is they’re trying to analogize the financial crisis to a natural disaster. How do you blame someone for a natural disaster? And you hear the same language from the Administration. You hear Timothy Geithner saying, “Well, do we want to protect against a hundred-year flood or a 30-year flood?”
I think this is all deeply wrong, and it’s an exact parallel to the Iraq War. Because you know, as we all remember, we invaded Iraq, we didn’t find Weapons of Mass Destruction, and what did people say? They said, “Oh, it was bad intelligence.” So people gathering the intelligence made mistakes, people analyzing the intelligence made mistakes, people brought the intelligence to President Bush and Vice President Cheney and they made an error of judgment because of the bad intelligence, and then a majority of the Congress went and voted for this war because they had been misled. It’s the same idea. It’s the same idea that it’s all an accident, it’s not our fault, it’s somebody else’s fault and it was just a big mistake. And in both cases that is just fundamentally wrong. I mean, we invaded Iraq because our political leaders wanted to invade Iraq, and our Congress voted for it because they did not want to be seen as voting against a war in the run-up to an election, and that’s all there is to it.
And with the financial crisis: I’m not saying that bankers wanted the financial crisis, but they engineered it. They engineered a climate of deregulation and non-regulation that allowed them to invent whatever products they wanted to, sell them to anyone they wanted to, increase their leverage so that they could make larger and larger profits, and they engineered that consciously. This was the product of intention, and it was bound to blow up. And it finally blew up. And that is the message that Wall Street does not want people to hear. They want people to think it was all a colossal mistake made by well-meaning people who had mistakes in their models. That is not what happened.

Moshe I believe that if UNP played its legitimate role properly, Sri Lanka would not have faced such drastic risks.
Even now it will be helpful if Sri Lanka has a main Opposition Party which puts Country first and the Party and party personnel second.
This will also influence the Government to be more focussed about governing rather than watching their back all the time.
For the outsiders' eye it may not be that visible how damaging the UNP's work during past few years. Some may believe that these were only political attacks but I believe that that the reality was much more dangerous and treacherous. Still it is.
But at the moment UNP will not be able to instantaneously play a positive role. It will remain treacherous for a while until they are convinced that they are politically dead. Still they have some political life.
The other thing is that I cannot explain Ranil's behaviour just by assuming him to be a natural traitor. He might very well be. Even then what he does does not help his game. His behaviour is lunatic, erratic and idiotic. If he is really his own man then he could have acted more prudently and subtly. (not saying things like Thoppigala is just a jungle etc.)
Maybe it is that some people who do not have any sense how the ordinary Sri Lankan's feel are giving him orders and he follows the orders not just because he is just a traitor but also because he has no other choice.
Just before the PE he stated that SF has no role in defeating the LTTE and SF followed MR's orders. (He may have wished SF's defeat but it does not completely explain it.)
Then he lamented Balasinghem called him a fox.
Then he was so upset some put the "blame" for Karuna's break from the LTTE on him. If he wanted votes he would have emphasised that it was his genious plan and he would have tried to share the glory of initiating Karuna's break and then consequenlty ensuring the defeat of the LTTE. ( I do not think Karuna's break was that significant even though he helped. For instance DB was able to emancipate the East even when Karuna was there.)
Then before the GE he said that he advised MR to stop the war as immediately as Mulathiv was fallen.
Maybe a foreign or the LTTE has something on him so he cannot play to be the most effective traitor. He has been even treacherous to his traitor role.
Even though there are some short comings with MR's team (some may be merely due to the momentum of the already corrupted political system), I wanted MR to have a 2/3 majority.
Signs are emerging that in search of 2/3 majority the Government is going to make deals with opportunistic and racist political parties.
I hope that here too MR would act as Houdini.
Whatever the shortcomings, the Sri Lanka cannot be in any better hands than in MR's and GR's
Sri Lanka needs a few more years to completely burry the LTTE and I have all the trust MR and GR will not be too fast or too slow.(JVP tried to destroy Sri Lanka by advocating the Government to go too fast hoping that Government would fail and then they could grab the power. When that fails they began to act more treacherous than UNP. More the defeat of the LTTE was certain, more they tried to bring down the Government.
Sri Lanka is not yet completely out of danger even though I envisage a really bright future for her. I know that Sri Lanka will prevail. The worst has gone but Sri Lanka should not let the guard down.

"Film footage from ‘Matha’ missing, says director"

A considerably long part of footage from the film ‘Matha’ has been found missing from the studio at Nawala. A complaint regarding the loss has been lodged with the Mirihana Police, says director Boodie Keerthisena.
‘Matha’, the film directed by popular Sri Lankan batik outlet owner and film director Buddhi Keerthisena’s son Boodie and produced by Ruwan Jayasinghe, is based on the island’s 30-year separatist conflict. Though the wide-screen movie was scheduled to be released in January 2010, it had been reportedly delayed.
The producers were under pressure from different quarters, local and international, to abandon the project as it dealt with the country’s conflict and was being made with the blessings of the government.

Apparently the "delay" in release is because the director has been writing the script as he goes along and changing bits here and there which has raised concerns on its quality, and annoyed others involved. That said the last bit in bold above is worrying and angering at the same time (it could also explain why there have been changes in script and delays).

Defeated Galle District United National Front (UNF) candidate Vajira Abeywardena, who is also the district organiser, said that he will make a decision on his political future within the next ten days.
Explaining further he said, “In a few days time, I will reveal things that people have not heard before. Things related to politics, our culture and basic human decency. People will be surprised to hear what I say. When I reveal those things I will also announce my future political actions.”
Responding to rumours that he was planning on moving to the Government if he is not awarded a national list seat, Abeywardena said, “Some ‘monkeys’ from the party have been spreading rumours. I’m not going to respond to such comments just yet. I have been speaking on politics for many years now. Give me a few days more and I will start speaking again.”
Abeywardena got the third highest preferential votes from the UNF for the Galle District. Therefore, he failed to win one of the two seats awarded to the UNF from the district.

"Six months ago, migrants who landed off the B.C. coast were deemed potential terrorist threats. Now many of them live in Toronto and collect welfare. What happened?...
When he fled Sri Lanka, he left his wife and little children behind, a move that haunts him. “It's been more than one year since I've seen my son,” he said, his dark brown eyes filling with tears.
He tried to stay out of politics, but by end of 2008, the artillery shells were landing too close to his farm fields, and the family fled. “My village was under the control of the army and I had no choice. They started killing people.”
The family lived on the run, sleeping under trees, moving from village to village. By the spring of 2009, there was no place to hide.
Government troops launched a final, decisive assault on the retreating Tigers, who forced thousands of civilians into labour or used them as human shields. When soldiers overran the north, they picked up civilians, including Selva's family, herding them into internment camps.
International human-rights groups have said nearly 300,000 civilians were held in these kinds of conditions as the war ended.
He said he and his four-year-old son were driven by bus to a camp that looked like an abandoned school, where about 4,000 men and boys were being held. He was questioned, he recalled, tied up and beaten. His interrogators wanted to know if he was a Tiger. “I didn't have anything to do with it,” he replied. “I'm a farmer. I didn't have time to think about politics.”
The Tamil made up his mind to escape. Some of the men in the camp were permitted to leave. Selva approached one and pressed a paper with his cousin's phone number in his hand.

Vaiko condemns deportation of LTTE chief's mom

CHENNAI: MDMK leader Vaiko has announced a mass protest fast April 23 to condemn the deportation of slain Liberation Tigers of Tamil Eelam (LTTE) leader Vellupillai Prabhakaran's ailing mother V. Parvathi.
In a statement issued here Saturday, Vaiko said: "MDMK will hold a mass protest fast in Chennai April 23 condemning the deportation of Parvathi Ammal by the Indian officials."
On Friday night, a paralysed 79-year-old Parvathi, who arrived here from Kuala Lumpur in a Malaysian Airlines flight, was not allowed to alight and was deported by immigration officials.
The officials refused her entry to India in view of the law and order problem it might create.
LTTE supporters, MDMK General Secretary Vaiko and Tamil Nationalist Movement leader P.Nedumaran who had gone to the Chennai airport to receive Parvathi, were denied entry into the airport.
PMK founder S. Ramadoss in a statement said: "It is only the immigration officials who would have done this highhanded and inhuman act."
He demanded that the central government permit Parvathi to enter India for treatment.
On April 13, an MP from Sri Lanka, M.K. Sivajilingam, who came here seeking medical treatment, was deported.

Timing is everything. With Washington putting renewed attention on regulation reform, the SEC's fraud charges against Goldman Sachs couldn't have come at a better time for supporters of the cause. "There is nothing in (the complaint) that would give comfort to people who are opposing more regulation on Wall Street," says Barry Ritholtz CEO of FusionIQ and author of Bailout Nation.
The focus comes later than some would have wanted, but as Ritholtz says, "the momentum is clearly moving in the direction of more regulation."
The SEC charged Goldman with misleading its customers by withholding "vital information" about a synthetic collateralized debt obligation (CDO) named Abacus that was intentionally stuffed with the most toxic subprime mortgage-backed securities. Goldman says the charges are "completely unfounded in law and fact."
Sen. Ted Kaufman of Delaware - one of the most outspoken supporters of reform - reacted to the charges with this statement:
"We can have only one justice system in this country for both the rich and powerful and those who are not. I'm not prejudging the merits of this action, but if we don't treat Wall Street firms that have allegedly defrauded investors of millions of dollars with the same gravity as we treat all others, why would our citizens have faith in the rule of law?"
Reform could hurt Goldman's profitability as well as what Ritholtz calls the firm's "golden boy" reputation in Washington. With former Goldman executives serving a variety of roles in recent administrations of both parties -- including Treasury Secretaries Robert Rubin and Hank Paulson -- the firm is often referred to as 'Government Sachs' by critics and admirers alike.
But the SEC's charges suggest the Obama administration is "no longer going to have a kid's glove approach to Goldman Sachs," Ritholtz predicts.

NEW YORK (Reuters) - Goldman Sachs Group Inc was charged with fraud by the U.S. Securities and Exchange Commission over its marketing of a subprime mortgage product, igniting a battle between Wall Street's most powerful bank and the nation's top securities regulator.
The civil lawsuit is the biggest crisis in years for a company that faced criticism over its pay and business practices after emerging from the global financial meltdown as Wall Street's most influential bank.
It may also make it more difficult for the industry to beat back calls for reform as lawmakers in Washington debate an overhaul of financial regulations.
Goldman called the lawsuit "completely unfounded," adding, "We did not structure a portfolio that was designed to lose money."
The lawsuit puts Goldman Chief Executive Lloyd Blankfein further on the defensive after he told the federal Financial Crisis Inquiry Commission in January that the bank packaged complex debt, while also betting against the debt, because clients had the appetite.
"We are not a fiduciary," he said.
The case also involves John Paulson, a hedge fund investor whose firm Paulson & Co made billions of dollars by betting the nation's housing market would crash. This included an estimated $1 billion from the transaction detailed in the lawsuit, which the SEC said cost other investors more than $1 billion. Paulson was not charged.
Fabrice Tourre, a Goldman vice president whom the SEC said was mainly responsible for creating the questionable mortgage product, known as ABACUS, was charged with fraud.
Goldman shares slid 12.8 percent on Friday, closing down $23.57 at $160.70 on the New York Stock Exchange. The decline wiped out more than $12 billion of market value, and trading volume topped 100 million shares, Reuters data show.
The news dragged down broad U.S. equity indexes, which fell more than 1 percent. The perceived risk of owning Goldman debt, as measured by credit default swaps, increased. Treasury prices rose as investors sought safe-haven government debt.
MORE SEVERE THAN EXPECTED
"These charges are far more severe than anyone had imagined," and suggest Goldman teamed with "the leading short-seller in the industry to design a portfolio of securities that would crash," said John Coffee, a securities law professor at Columbia Law School in New York.
"The greatest penalty for Goldman is not the financial damages -- Goldman is enormously wealthy -- but the reputational damage," he said, adding that "it's not impossible" to contemplate that the case could lead to criminal charges. Coffee spoke on Reuters Insider.

Goldman vowed to defend itself.
"The SEC's charges are completely unfounded in law and fact," it said. "We will vigorously contest them and defend the firm and its reputation."
E-mails from former Washington Mutual Inc CEO Kerry Killinger read aloud during a congressional hearing this week illustrated clients' concerns about working with Goldman.
In 2007, Killinger discussed hiring Goldman or another investment bank to help Washington Mutual find ways to reduce its credit risk or raise new capital, according to one of the e-mails, which Michigan Democratic Sen Carl Levin read during the hearing.
"I don't trust Goldie on this," Levin quoted one of Killinger's e-mails as saying. "They are smart, but this is swimming with the sharks. They were shorting mortgages big-time while they were giving (Countrywide Financial Corp) advice."
The SEC lawsuit announced on Friday concerns ABACUS, a synthetic collateralized debt obligation that hinged on the performance of subprime residential mortgage-backed securities, and which the regulator said Goldman structured and marketed.
According to the SEC, Goldman did not tell investors "vital information" about ABACUS, including that Paulson & Co was involved in choosing which securities would be part of the portfolio.
The SEC also alleged that Paulson took a short position against the CDO in a bet that its value would fall.
In a statement, Paulson & Co said it did buy credit protection from Goldman on securities issued in the ABACUS program, but did not market the product.
Tourre was not immediately available for comment.
Goldman had not disclosed that the SEC was considering a lawsuit but had known charges were possible and had urged the SEC not to file them, people familiar with the situation said on Friday. The sources requested anonymity because the probe was not public.
To better understand CDOs, the SEC in 2008 approached some hedge funds, including Paulson & Co, whose investment Paulo Pellegrini was among those to talk with the regulator.
By betting against subprime mortgage-related debt, Pellegrini helped Paulson's firm earn an estimated $15 billion in 2007. Pellegrini last year left to start his own firm.
COMING OUT SWINGING
The lawsuit is a regulatory and public relations nightmare for Blankfein, who has spent 18 months fending off complaints that Goldman has been an unfair beneficiary of taxpayer bailouts of Wall Street.
Blankfein became chief executive less than a year before the product challenged by the SEC was created.
"This could be the beginning of a period where you have a regulatory cloud over Goldman Sachs, and perhaps even the entire investment banking industry," said Hank Smith, chief investment officer at Haverford Trust Co in Philadelphia.
John Paulson is not related to Henry "Hank" Paulson, who was Blankfein's predecessor as Goldman chief executive and later become U.S. Treasury secretary.
The SEC lawsuit represents an aggressive expansion of regulatory efforts to hold people and companies responsible for the nation's financial crises.
It could help the regulator rehabilitate its reputation after missing other high-profile cases, including Bernard Madoff's Ponzi scheme.
"The SEC has come out swinging," said Cary Leahey, senior managing director of Decision Economics in New York.
Robert Khuzami, head of the SEC's enforcement division, said John Paulson was not charged because it was Goldman that made misrepresentations to investors, not Paulson.
Still, Khuzami called Paulson's firm "a hedge fund that had a particular interest in the securities performing poorly."

MORE LAWSUITS TO COME?
It is unlikely that criminal charges will be brought, a person close to the matter said. Representatives for the Justice Department declined to comment.
Yet the lawsuit is widely expected to spur other lawsuits, and is "probably the first of several," according to Doug Kass, president of hedge fund Seabreeze Partners Management.
"Regulators and plaintiffs' lawyers are going to be looking at other deals, to what kind of conflicts Goldman has," said Jacob Zamansky, a lawyer who represents investors in securities fraud lawsuits.
"I've been contacted by Goldman customers to bring lawsuits to recover their losses," he added. "With the SEC bringing fraud charges it's going to expose what's behind the curtain."
E-MAIL TRAIL
According to the SEC, Goldman marketing materials showed that a third party, ACA Management LLC, chose the securities underlying ABACUS, without revealing Paulson's involvement.
The SEC complaint quotes extensively from internal e-mails and memos, noting that in early 2007 it had become difficult to market CDOs tied to mortgage-backed securities.
It quoted a January 23, 2007, e-mail from Tourre to a friend as saying: "The whole building is about to collapse anytime now ... Only potential survivor, the fabulous Fab ... standing in the middle of all these complex, highly leveraged, exotic trades he created without necessarily understanding all of the implications of those monstrosities!!!"
Another e-mail, to Tourre from the head of Goldman's structured product correlation trading desk, complained: "The CDO biz is dead we don't have a lot of time left."
INDEPENDENCE MATTERS TO CLIENTS
Other communications detail the importance of hiring ACA.
The SEC said Goldman reached out to German bank IKB to buy securities that Paulson was selling, knowing it would buy only securities selected by an independent asset manager.
"We expect the strong brand-name of ACA as well as our market-leading position in synthetic CDOs of structured products to result in a successful offering," a March 12, 2007, Goldman e-mail said.
IKB ultimately took on exposure to ABACUS, as did the Dutch bank ABN Amro Holding NV.
The German government ultimately bailed out IKB in the summer of 2007, in part because of the bank's investments, while lenders that eventually bought much of ABN Amro were also subjected to their own government bailouts.
In a statement after U.S. markets closed, Goldman said it lost more than $90 million on the transaction, six times the $15 million fee it received, and provided "extensive disclosure" on the securities involved.
It also said it never represented to ACA Capital Management, which invested $951 million in the transaction, that Paulson was going to be a "long" investor, meaning that Paulson was betting the securities would gain in value.
Paulson & Co paid Goldman $15 million to structure and market the ABACUS CDO, which closed on April 26, 2007, the SEC said. Little more than nine months later, 99 percent of the portfolio had been downgraded, the SEC said.
Janet Tavakoli, president of Tavakoli Structured Finance Inc in Chicago and author of a book on synthetic CDOs, said it may have been common on Wall Street for hedge funds to play big roles in picking mortgage-backed securities for use in CDOs.
"Many investors were not aware of how disadvantaged they were by these CDO structures," she said.

WASHINGTON IMPACT
The charges are expected to fuel anti-Wall Street sentiment on Capitol Hill where sweeping financial industry reforms are expected to soon arrive on the Senate floor for a vote.
A Democratic bill, strongly supported by President Barack Obama, would slap new restraints on major banks, likely curtailing their opportunities for profit and revenue growth.
Similar legislation was approved in the House of Representatives in December. Analysts believe a bill could be signed into law by Obama by mid-year.
"Banks were getting their mojo back, successfully fighting the regulatory reform bill," said James Ellman, president of Seacliff Capital in San Francisco. "Clearly, such malfeasance could help get the bill to go through."
Goldman in 2008 won a $5 billion investment from Warren Buffett's Berkshire Hathaway Inc.
Last month, Buffett praised Goldman as a "very, very strong, well-run business," and said of Blankfein, "You cannot find a better manager."
Buffett had no immediate comment, his assistant Carrie Kizer said.
The SEC lawsuit was assigned to U.S. District Judge Barbara Jones, who was appointed to the bench in 1995 by President Bill Clinton. She presided over the 2005 criminal trial of former WorldCom Inc Chief Executive Bernard Ebbers over an $11 billion accounting fraud at the phone company.

New parliament warned of moves to revive separatist sentiments

Defence Secretary Gotabhaya Rajapaksa says the new SLFP-led UPFA government should be prepared to thwart a fresh attempt by separatists operating abroad to throw a lifeline to the LTTE. A section of the international community, he says, is bent on reviving the LTTE and giving it recognition.
In an exclusive interview with The Island, Defence Secretary Rajapaksa discussed a range of issues, including the need to maintain political stability, strengthening the economy and the responsibility of the new government, which would be installed next week, to sustain a cohesive security policy. He also emphasised the pivotal importance of the judiciary, particularly the Attorney General’s Department, in supporting the government’s efforts to suppress terrorism.
Suppressing the separatist movement and tackling its propaganda apparatus should be a major part of Sri Lanka’s strategy against the LTTE, he said. The new government should go all out against any local element promoting separatist sentiments regardless of political consequences, he said, emphasising that the country could not afford to make way for terrorists.
The Defence Secretary said that the next parliament should introduce new laws to meet security requirements. Responding to a query by The Island, the former Gajaba veteran said that Opposition political parties or constituent partners of the ruling coalition should not be allowed to engage in divisive politics.
In his first public comments after the April 8 general election, the Defence Secretary said that the LTTE would not have lasted 30 years, had previous governments acted wisely. The destruction of the LTTE’s conventional military capability about a year ago might give a false sense of complacency to the political establishment, he said. Pro LTTE sections of the Tamil Diaspora, he said, were carrying out a high profile campaign against Sri Lanka. The Global Tamil Forum was lobbying overseas to win over foreign politicians. He said that the presence of high profile British politicians and officials at a recent gathering of GTF in the UK had revealed the gravity of the situation.

The Defence and Foreign Ministries should work together to meet new threats posed by a determined enemy, which had financial resources at a global level even to subvert a sovereign country, the Defence Secretary said.
Referring to recent British press reports that Islamic radicals had infiltrated the British Labour Party, Defence Secretary Rajapaksa said that the Tamil Diaspora could adopt a similar strategy, if it had not already done that. The Telegraph recently quoted Environment Minister Jim Fitzpatrick as having said that the Islamic Forum of Europe (IFE) had infiltrated the Labour Party. Minister Fitzpatrick alleged that the IFE was trying to create an Islamic social and political order in Europe. The Telegraph quoted him as having said, "IFE had become, in effect, a secret party within Labour and other political parties. They are placing people within political parties, recruiting members to those political parties, trying to get individuals selected and elected so they can exercise political influence and power…"
Defence Secretary Rajapaksa said that the next six years would be of crucial importance to the country as the first government elected in a post-LTTE era had to tackle a separatist threat in a different manner. ‘They may not have artillery pieces in their arsenal and their strategy will be different, but let me tell you their goal will be the same," he warned. He expressed concern that a section of officialdom could help the separatist cause by trying to appease foreign governments and some funding agencies. He said that those who pontificated to Sri Lanka about the virtues of human rights, media freedom and democracy were the worst culprits responsible for crimes against civilians. He said that international press coverage of the situation in Afghanistan and Iraq would help people understand to what extent foreign powers would go to protect their security and economic interests, though Sri Lanka was being asked to give in to a bunch of killers.
Defence Secretary Rajapaksa said that they could not turn a blind eye to about 12,000 LTTE cadres taken into custody at the end of the war. Although a sizeable section of them had been released, the government could not totally dismiss the possibility of their being recruited again by what was left of the LTTE, he said. He urged political parties to be aware of the danger of promoting separatist opinion at a time the new government would have to rehabilitate and gradually release over 9,000 detainees.
Gotabhaya said that the recent move to release some LTTE operatives held in connection with the assassination of Gen. (retd) Janaka Perera revealed the danger in taking the situation lightly. Timely intervention by the Defence Ministry had prevented their release. He said that the political establishment would have to take into consideration the security aspects of even on-going judicial proceedings as part of their overall measures to sustain maximum possible pressure on the separatist movement. He said that many hasten to criticise the armed forces, particularly the intelligence services for lapses, though those critics never lifted a finger to help the armed forces in war against the LTTE.

Thanks for the link. Looks really cool film. The thing about a film like this is that you have to get it absolutely right so that it would not be highly biased towards Tamils at the same time portraying what happened during the war.
A GOOD LESSON FOR SRI LANKA AS WELL:
When commercial institutions are allowed to become comparable in size to the entire economy of a nation, they will become law unto themselves at the expense of the citizens ... this places the entire society in jeopardy.
The solution is to introduce anti-monopoly regulation to break them up, and prevent their re-consolidation and re-growth to unacceptable size in the future.
The nation must be managed for the benefit of all of its people, and not to benefit a wealthy cabal of oligarchs.

By all appearances, the major banks— at least the ones that survived intact— were the big winners of the financial crisis. JPMorgan Chase, Bank of America, and Wells Fargo bought up failing rivals to become even bigger. The largest banks increased their market shares in everything from issuing credit cards to issuing new stock for companies. Goldman Sachs reported record profits and, through September 2009, had already set aside over $500,000 per employee for compensation. Lloyd Blankfein, CEO of Goldman Sachs, was named Person of the Year by the Financial Times.
The implications for America and the world are clear. Our big banks have only gotten bigger. In 1983, Citibank, America’s largest bank, had $114 billion in assets, or 3.2 percent of U.S. gross domestic product (GDP, the most common measure of the size of an economy).
By 2007, nine financial institutions were bigger relative to the U.S. economy than Citibank had been in 1983. At the time of the White House meeting, Bank of America’s assets were 16.4 percent of GDP, followed by JPMorgan Chase at 14.7 percent and Citigroup at 12.9 percent.
A vague expectation that the government would bail them out in a crisis has been transformed into a virtual certainty, lowering their funding costs relative to their smaller competitors. The incentive structures created by high leverage (shifting risk from shareholders and employees onto creditors and, ultimately, taxpayers) and huge one-sided bonuses (great in good years and good in bad years) have not changed. The basic, massive subsidy scheme remains unchanged: when times are good, the banks keep the upside as executive and trader compensation; when times are bad and potential crisis looms, the government picks up the bill.
If the basic conditions of the financial system are the same, then the outcome will be the same, even if the details differ. The conditions that created the financial crisis and global recession of 2007–2009 will bring about another crisis, sooner or later. Like the last crisis, the next one will cause millions of people to lose their jobs, houses, or educational opportunities; it will require a large transfer of wealth from taxpayers to the financial sector; and it will increase government debt, requiring higher taxes in the future. The effects of the next meltdown could be milder than the last one; but with a banking system that is even more highly concentrated and that has a rock-solid government guarantee in place, they could also be worse.

The alternative is to reform the financial system now, to put in place a modern analog to the banking regulations of the 1930s that protected the financial system well for over fifty years. A central pillar of this reform must be breaking up the megabanks that dominate our financial system and have the ability to hold our entire economy hostage. This is the challenge that faces the Obama administration today. It is not a question of finance or economics. It is ultimately a question of politics— whether the long march of Wall Street on Washington can be halted and reversed. Given the close financial, personal, and ideological ties between these two centers of power, that will not happen overnight.
We have been here before. The confrontation between concentrated financial power and democratically elected government is as old as the American republic. History shows that finance can be made safe again. But it will be quite a fight.

Prabakaran mother's name was on ‘Warning Circular' list

CHENNAI: The immigration authorities at the Chennai airport were surprised to see Parvathi, mother of slain LTTE leader Prabakaran, when she landed from Malaysia with a valid medical visa at the airport here on Friday night.
The reason: her name was on the ‘Warning Circular' list of the Union government. Whenever a person's name finds a place in the list, the visa issuing authorities must obtain the approval of, or consult, officials of the Home Ministry before issuing him or her a visa.
Though Ms. Parvathi's name was on the list, she got a medical visa.
Sources in the Immigration said both Velupillai and his wife Parvathi were living in Tiruchi till 2003.
Soon after they migrated to Colombo, the Tamil Nadu government requested the Centre, in the same year, to ban their return.
Accordingly, the Union government banned their entry into the State and put their names on the list.
Ms. Parvathi was sent back to Malaysia by the same flight.

Banning her was done long time ago, when she went from TN to SL. The banning thing has been active since then. I don't think anyone knew about this. They say the Indian HC in India should have requested special permission prior to giving her visa when this type of bans are in place.

For example there is talk of India getting an island in northern Maldives for military purposes.
From an administrative viewpoint also, it doesn't make much sense because their population is < 400,000. And 1/4 is in the capital.

Amparai
Amparai (Digamadulla) was a new district carved out from the former Batticaloa South areas. It is the district with the least number of Tamils (19%).Though one of the seven seats from the district was expected to go to a Tamil such a possibility could be possible only through a strong show of ethnic unity.
There was also the question of whether any Tamil candidate let alone one from the TNA winning from Amparai district.
One reason for this was that the ruling UPFA had a controversial yet strong Tamil candidate in their ranks. This was none other than Kumarasamy Pushpakumar alias “Iniyabharathi.”
Iniyabharathi was a key deputy of Vinayagamoorthy Muraleetharan alias “Col” Karuna,former TMVP leader and present vice – president of Sri Lanka Freedom Party (SLFP)Iniyabharathy was also a special coordinator for Amparai district appointed by President Mahinda Rajapakse
Iniyabharathi with his strong – arm tactics and access to the throne of power was seen as a force to be reckoned with in Amparai district. During the polls campaign his goondas had restricted canvassing by the TNA candidates to some extent in certain Tamil inhabited areas of the district.
When the results were announced a political “upset” had taken place. The TNA won the Tamil seat but the winner was a Tamil – speaking Sinhala person. The TNA Parliamentarian elect from Amparai district was Podiappuhamy.H.B. Piyasena with 11,139 preference votes.
The unassuming Piyasena’s Sinhala father hailing from Devinuwara had settled down in Akkaraipattru in Amparai district with a Tamil wife. Piyasena’s siblings were all educated in the Sinhala medium with a brother being principal of a Sinhala school
Piyasena too had his early education in Sinhala but reverted to Tamil medium in deference to his mother’s wishes. Though he wanted to join the Police force in his younger age Piyasena had changed his mind after witnessing and experiencing police brutality
Piyasena is for practical purposes a “Tamil with a Sinhala name” and owns two businesses in Akkaraipattru and Thirukkovil. He speaks Tamil fluently with a distinctive eastern Tamil accent.
Born in 1961 Piyasena was involved with Eelam Peoples Revolutionary Liberation Front(EPRLF) politics during his youth. At one point he was under death threat from the LTTE and was forced into hiding.
The new MP remains an ardent, devout Buddhist. His children have been given Tamil names and study in the Tamil medium. They are fluent in Sinhala and Tamil like their father.
Piyasena was elected to the Aalaiaddyvemby Pradeshiya Sabha on the TNA and has functioned as deputy –chairman of the council. He had agreed to contest Parliamentary polls without any expectation of victory. Piyasena’s only condition had been that he should be made the Aalaiyaddyvembu Pradeshiya Sabha chairperson in due course.

Piyasena had campaigned alone during the pre-elections period. He had bought a three-wheeler and modified it by mounting a mini –platform behind. After painting the vehicle “blue” in SLFP colours as a safety measure he had driven throughout the length and breadth of his constituenct appealing to voters on a personal basis via megaphone and distributing handbills.Only a driver accompanied him.
Piyasena’s unorthodox campaigning seems to have been a success and when results were announced the “dark” horse had won.
Success however was not so sweet as enraged Tamil goonda supporters of Iniyabharathy allegedly attacked his house and forced him into de-facto “house arrest”. TNA leader R.Sampanthan had lodged strong protests with the Police hierarchy and around 15 goons have reportedly been arrested.

Maybe it is time we educate people from Maldives why it is in our best interest to keep these goons away from their land. Where ever these people go, the countries and their people gets destroyed. Google Earth has updated satellite images over Puthumathalan, Mullivikkal, and Puthukuduirippu. These areas were imaged on 2009-03-16 and 2009-06-16. They look very interesting if you know where and what to look for.

UPFA is expected to win 143/144 while JVP gets 6/7. Means UPFA+JVP have 150 which is 2/3. Actually if JVP didn't break away and stay together with MR and also if not for Gonseka's gonparts UPFA could get 150+ easily.
Anyway the point is nationalistic mass has got 2/3. This is based on the realistic assumption >90% of JVP voters are nationalistic despite their opportunistic leaders.
The other point is JVP has qualitatively gone down than 1994. JVP lost their stronghold Hambanthota seat which they had since 1994. The real JVP (those who fought and died) consist from rural youth not from western province. So JVP losing Hambanthota and gaining 4 seats from western province (actually 5, with one national seat from western province votes) indicates their start of extinction from rural areas and becoming temporary choice for floating voters in towns.

Not necessarily. However, note that MR kept similar high % since 1989 and that explicitly stated and noted popularity within district helped him to expand his image nationwide and within own party and finally the leadership.
SP is similarly maintaining his high % since 1994 yet I think he has to go far to follow MR. I think it will be relatively harder SP in UNP to do what MR did in SLFP.
NR has to go long way - time will tell.
RW despite being the leader of a main party and running in the most favorable district and ranked #10 clearly shows his decreasing popularity within own party.
For UPFA, the best thing is to keep RW in UNP leadership but need to replace IF UNP coming to power.

The only way we can silence this all is to fire back the “war crimes” & “human rights” bs right at the West. Mervin is a well intended man, but he needs to understand the limitations. He was elected to the legislature of Sri Lanka. If he wants to ban alcohol directly, i.e. regulate commerce, then he has to follow the appropriate procedure through the parliament. He cannot act on his own in this matter. He is acting out of line. To me this is not about banning alcohol but containing him within powers vested on him by the people.

Alcohol ban,
I am against a ban of this nature as it is too direct.
I would rather see education campaigns and use of media to “condemn” alcohol consumption. Such a campaign should be done focusing on the effect alcohol has on your body organs and toss in learning/mental difficulties, and how as a result you will be not only a shame for your family but also unable to provide for them/look after your parents/fail in your studies etc.
That kind of angle needs to be taken to ensure alcohol consumption is reduced; education campaigns which show intoxicated behaviour (as done in the West) has only glorified alcoholism and had the opposite effect of encouraging more drinking than reducing it as throwing up and falling unconscious on the road is now a status symbol than a deterrent.
There also needs to be ads showing how a drunk driver kills an innocent father for example who provides for his family etc, not what happens to the driver, but his victim, to hammer home drinking alcohol is wrong/bad.
A point blank ban will only make people WANT to drink and of course increase underworld markets as SU has said because those that do drink have not been convinced why they should not, all they have is a sudden ban slapped on for no real reason and not only does it increase resentment but increases those who wish to subvert it to get alcohol which will create a whole new mafia.
No point in going for the symptoms rather than the cause as it is -To give another example last year a school girl killed herself and the school blamed the girl and tossed in mobile phones resulting in a “plaster” type remedy of banning phones from schools when the real issue of the behaviour of some teachers in some schools was over looked as many outraged individuals pointed.

I am against a ban of this nature as it is too direct.
I would rather see education campaigns and use of media to “condemn” alcohol consumption. Such a campaign should be done focusing on the effect alcohol has on your body organs and toss in learning/mental difficulties, and how as a result you will be not only a shame for your family but also unable to provide for them/look after your parents/fail in your studies etc.

Previously I was of the same opinion as well. But countries like Australia, although we calls it democratic has ways of stopping these things by taxing these items.
Recently we had the situation of youngsters consuming high level of mixed alcohol. The government increased the tax so that it becomes so expensive. Same way with the cigarettes in Australia. Things like ban on Chewing gum in Singapore.
So, what Mervin is doing something similar, but in a different manner. Even if Mervin Brings in a Ban, it is not going to stop people from drinking, but making the access bit more difficult.
If we keep on discussing about this, it would take a long time, but if we implement at one place, people would start talking about it and think would be expedited.
There is no question about banning alchohol, cigarettes etc, but it is good to identify these as problem areas and then focusing on ways on how to solve these problems.
Mervin's Shot gun tactics gives a starting point for people to debate on these things. After seeing his interview, me for one agrees with his points of view. He mentioned in the interview that we go nowhere with discussions. Definitely would not advocate that this would happens every where in the country, but a guy like him definitely serves a purpose and a catalyst for social change.
Also the way he spoke about it TV, he didn't seem to trying to score some points in his political career, but rather doing it out of convictions. Also this does send the business community, don't heavily rely on making money by exploiting peoples vices.

Using the above logic Sinhalese were in the North and East for greater periods before Tamilia and were only displaced from it during European occupation when Tamils were imported into Sri Lanka, so we have more of a right lead our lives in the N & E than them.

Colombo, 20 April (Asiantribune.com): The swearing of Sarath Fonseka as the Member of Parliament on 22nd of this month when the new Parliament is convened is still unclear. It is unclear whether he will be ever sworn in as he is faced with knotty legal problems to overcome.
Asian Tribune learnt that already Sarath Fonseka’s lawyer as well as Vijitha Herath, the Secretary to the newly formed Democratic National Alliance have written letters to the Secretary General of the Sri Lanka Parliament Dhammika Kitulgoda, urging him to arrange for the swearing of Sarath Fonseka, who is held under custody at the Naval Headquarters by the Sri Lanka Army.
Parliament Secretary General when contacted told Asian Tribune that he had received two letters, one from Sarath Fonseka’s lawyer and other from Vijitha Herath, requesting him to arrange for the swearing in of Sarath Fonseka as a Member of Parliament on 22nd of April, when the new parliament expected to be convened.
He further said that he has forwarded those two letters to the Secretary of Defence, “only for his information.”
Talking to Asian Tribune, Dhammika Kitulgoda said “ I have no legal authority to instruct anyone or to request anyone to allow Sarath Fonseka to take oaths in the Parliament.”
He added: “My letter has no binding at all. I just facilitated and made use of my office by forwarding those two letters to Secretary of Defence.”
The Secretary General of the Parliament categorically told Asian Tribune “the decision of allowing or not allowing Sarath Fonseka to participate in the swearing is left to them. I have not directed anyone to do so, as I have no power to do so.”
In the meantime, it is learnt that even if Sarath Fonseka files a fundamental rights petition in the Supreme court for the direction to the Army to take him to the Parliament for swearing in, it is highly unlikely that the Apex Court would interfere with the proceedings of the two court martial hearings and overlook and order while the court martial hearings are in progress.
Already two Court Martial have been convened and the second court martial trial is expected to take place today after it was postponed yesterday.
Legal experts when contacted said that if either the Commander of the Army or the Commander in Chief (Sri Lanka President) interferes and order the army to take Sarath Fonseka to the Parliament, it would amount to the mockery of the arrest, custody and the constitution of the two court martial for offences alleged to have been committed by Sarath Fonseka under the Army Act, during his tenure as the Commander of the Sri Lanka Army.
Legal experts told Asian Tribune that Sarath Fonseka has only one alternative left and that is to move motions with two courts martial and obtain their permission to attend the parliament for his swearing in.
It is said that he may be able to move a motion in the second court martial which is expected to continue its hearing today, but in the case of moving a motion in the first court martial, he has to wait until it come forward to commences its sittings.
In the meantime, the DNA Member and Former JVP Parliamentary Group Leader Anura Kumara Dissanayake speaking to journalists yesterday stated that persons who are in charge of him at the Navy Headquarters, where he is currently being detained, are bound to allow him to participate in the Parliament according to the law.
But when Asian Tribune contacted a few legal expert, they told that there are no precedents regarding the issue of swearing of an elected member of parliament when he is held in custody, they said it is a knotty problem and those who are holding him in custody has no authority to allow him to participate in the swearing in, without explicit directions from the two courts martial where Sarath Fonseka is being tried now.
They also said it is not binding on any authorities who are responsible for holding him in custody to facilitate the suspect to swear-in in the Parliament.

While i extremely dislike Mervin his "reputation" increased following his anti-Sirasa speech (or was it an attack/both?) couple years back where he said "Sirasa is destroying our culture by parroting & importuning crude programming and ideas from the West".
Lots of people were impressed with his statement, especially at time with the war in full swing and Sirasa backing the LTTE.
From those I interact with in SL (including die hard Ranil supporters and one or two Gonseka backers) very few actually hate Mervin per se. He is sort of the “lovable thug”. Without him they have little to bash MR with.
I really doubt this “manipulation of preferential votes” claims, sounds more like jillmart at counting centre and usual loser talk at work. However possibility of violence & intimidation against other candidates during the campaigning period having an effect may have more to do with it than jillmart.

As I know every candidate send their agents for each counting center. From the point of opening boxes, separating party wise, counting party wise, counting manapa, recording, reporting and everything was done under these agents observation.
Claiming such gilmart happened has become the norm for all losers. The less understanding voters have about counting related procedures is exploited. If there is any such malpractice these guys should be able to prove it in court. Also, they should be able to point out what and how exactly such malpractice happen and suggest alternative method for prevention. Before the election what opposition said was "they did gilmart in PE but there is no room for gilmart this time - we have fixed it and we will win so come and vote". After election losers say "they did gilmart and we are the winners". This is a joke.

Correct about Western SL Moshe. There has to be good water management policies (not foreign NGO type solutions) for SL. And developing other cities/towns will also move people away from the Western side, which will reduce pressure on resources there.
Also agree about a possible invasion from TN. A future threat from India/TN may not be about TE aspirations, but over lack of natural resources in India/TN!
But they may use TE as a pretext. Like WMDs.
I hope India will manage its water and resources for the sake of its people and for our sake.

I think that we should not worry about securing a 2/3rd majority for the following reasons.
(1) We have a stable government in place to secure next 6 years of the nation which I would like to call the golden age of Sri Lanka.
(2)Any new constitutional changes should be for a stable future of Sri Lanka. It shall never be implemented in the way JRJ did in 1977 to serve personal needs. Instead, it should be implemented to secure our future. If we can draft a good constitution, patriotic elements within UNP is likely to vote for it since it will take them out of the hell hole they are in now.
In summary UPFA has enough power to run a stable government without bending over backwards for minority parties. At the same time UPFA has not got enough power to arbitrarily change the constitution.

While its true that SL/sinhala culture (cinema/music) close to north india than south india we should not forget that SL culture is unique and its not north indian culture and should not be rather remain as SL culture aka sinhala culture or more precisely sinhala buddhist culture. It was indeed one of the most decicive battles fought against European invaders. This was not a mere skirmish, but a major battle involving thousands of soldiers, cannon, fire arms, cavalry, and battle elephants. I have P.E. Pieris's book 'Ceylon and the Portuguese, 1505-1658' in my library and it's got a very good account of it:
In May 1559 Dom Jorge de Meneses Baroche succeeded veteran Affonco Pereira in the command, and was able to drive back a small army which was advancing under Wikramasinha Mudaliyar. RajaSinha (Prince Tikiri Bandara), however, hastened up in person and a powerful body of expert target-men, supported by elephants and cavalry and the bravest soldiers of Aturugiri Korale and Koratota, were hurled at the Portuguese. The great tract of low land lying between Mulleriyawa and Kaduwela, twelve miles from Colombo, which is yearly enriched by the alluvial deposits left by Kelani Ganga when swollen with the monsoon rains, was this day the scene of a terrible fight. Rajasinha himself attacked the Portuguese in front, while Koratota and Hewagama Arachchis took them from the rear. The carnage was terrible, but though the Sinhalese were mown down by the firearms of their opponents, they still pressed on reckless of life, clinging to the tails of elephants in their efforts to get within striking distance of the enemy. In the thickest of the fight was to be seen Rajasinha on his horse, commanding, exhorting, encouraging his men by word and deed. The war elephants were now thundering down upon them, and one of the beasts rushed at de Meneses with uplifted trunk as he again tried to rally his men, but a fortunate shot turned it back and he had time to escape. The elephant Viradareya-the Mighty of Strength- hurled the Ensign Luis de Lacerda through the air and captured the Banner of Christ, but still the Portuguese fought on with teeth and nails, for their powder was now exhausted. Their complete destruction seemed assured, when a soldier fired a berco which they were abandoning right into the midst of the men who crowded round the passage, with fearful affect. The Sinhalese opened out their ranks and gave the Portuguese an opportunity of reaching the river and getting board the vessels which were waiting there. Only a demoralized and weary handful succeeded in reaching the camp, where de Menses threw himself on the ground, cursing himself in the depth of his despair.
