UN Secretary General Ban Ki-Moon Exceeds his Authority Under the UN Charter in Appointing UN Panel to Investigate Sri Lanka's Domestic Matters!

The unilateral action of the Secretary General of the United Nations, Mr. Ban Ki Moon, in appointing a UN Panel to investigate any "War Crimes" that may have been committed in Sri Lanka by the warring parties in the recently concluded war against terrorists, appears to exceed his authority under the UN Charter, in that this is purely an internal domestic matter under Sri Lanka's sole jurisdiction, that did not, and does not, threaten international peace.

For example, Article 2, Item #7, of the UN Charter, states

Nothing contained in the present Charter shall authorize the United Nations to intervene in matters which are essentially within the domestic jurisdiction of any state, or shall require the Members to submit such matters to settlement under the present Charter; but this principle shall not prejudice the application of enforcement measures under Chapter VII.

Since this matter does not threaten international peace, the provisions of Chapter VII do not apply to it.

As such, the Secretary General's appointment of this UN Panel amounts to unwarranted interference in the domestic matters of the sovereign UN member state of Sri Lanka, that is not sanctioned by the UN Charter which specifically prohibits such intervention.

In recent years, the United Nations has sanctioned several such illegal actions against a number of countries at the bidding of certain powerful western nations who act with impunity. It is high time that the vast majority of member states of the UN, who do not agree with these high-handed interventions, organize and act to prevent the misuse of the United Nations as a cover to demonize and punish targeted nations, at the bidding of powerful nations with self-serving political agendas of their own that are unrelated to the allegations made against those countries.

I present below the full text of the UN Charter of 26th June, 1945, to assist the readers of this blog to do their own legal analysis of the situation. I will add all amendments to this version of the UN Charter in due course.

Charter of the United Nations (June 26, 1945)

Preamble

We the Peoples of the United Nations Determined

to save succeeding generations from the scourge of war, which twice in our lifetime has brought untold sorrow to mankind, and

to reaffirm faith in fundamental human rights, in the dignity and worth of the human person, in the equal rights of men and women and of nations large and small, and

to establish conditions under which justice and respect for the obligations arising from treaties and other sources of international law can be maintained, and

to promote social progress and better standards of life in larger freedom,

And for these Ends

to practice tolerance and live together in peace with one another as good neighbors, and

to unite our strength to maintain international peace and security, and

to ensure by the acceptance of principles and the institution of methods, that armed force shall not be used, save in the common interest, and

to employ international machinery for the promotion of the economic and social advancement of all peoples,

Have Resolved to Combine our Efforts to Accomplish these Aims

Accordingly, our respective Governments, through representatives assembled in the city of San Francisco, who have exhibited their full powers found to be in good and due form, have agreed to the present Charter of the United Nations and do hereby establish an international organization to be known as the United Nations.

CHAPTER I

PURPOSES AND PRINCIPLES

Article 1

The Purposes of the United Nations are:

1. To maintain international peace and security, and to that end: to take effective collective measures for the prevention and removal of threats to the peace, and for the suppression of acts of aggression or other breaches of the peace, and to bring about by peaceful means, and in conformity with the principles of justice and international law, adjustment or settlement of international disputes or situations which might lead to a breach of the peace;

2. To develop friendly relations among nations based on respect for the principle of equal rights and selfdetermination of peoples, and to take other appropriate measures to strengthen universal peace;

3. To achieve international cooperation in solving international problems of an economic, social, cultural, or humanitarian character, and in promoting and encouraging respect for human rights and for fundamental freedoms for all without distinction as to race, sex, language, or religion; and

4. To be a center for harmonizing the actions of nations in the attainment of these common ends.

Article 2

The Organization and its Members, in pursuit of the Purposes stated in Article 1, shall act in accordance with the following Principles.

1. The Organization is based on the principle of the sovereign equality of all its Members.

2. All Members, in order to ensure to all of them the rights and benefits resulting from membership, shall fulfill in good faith the obligations assumed by them in accordance with the present Charter.

3. All Members shall settle their international disputes by peaceful means in such a manner that international peace and security, and justice, are not endangered.

4. All Members shall refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any state, or in any other manner inconsistent with the Purposes of the United Nations.

5. All Members shall give the United Nations every assistance in any action it takes in accordance with the present Charter, and shall refrain from giving assistance to any state against which the United Nations is taking preventive or enforcement action.

6. The Organization shall ensure that states which are not Members of the United Nations act in accordance with these Principles so far as may be necessary for the maintenance of international peace and security.

7. Nothing contained in the present Charter shall authorize the United Nations to intervene in matters which are essentially within the domestic jurisdiction of any state or shall require the Members to submit such matters to settlement under the present Charter; but this principle shall not prejudice the application of enforcement measures under Chapter VII.

CHAPTER II

MEMBERSHIP

Article 3

The original Members of the United Nations shall be the states which, having participated in the United Nations Conference on International Organization at San Francisco, or having previously signed the Declaration by United Nations of January 1, 1942, sign the present Charter and ratify it in accordance with Article 110.

Article 4

1. Membership in the United Nations is open to all other peace-loving states which accept the obligations contained in the present Charter and, in the judgment of the Organization, are able and willing to carry out these obligations.

2. The admission of any such state to membership in the United Nations will be effected by a decision of the General Assembly upon the recommendation of the Security Council.

Article 5

A member of the United Nations against which preventive or enforcement action has been taken by the Security Council may be suspended from the exercise of the rights and privileges of membership by the General Assembly upon the recommendation of the Security Council. The exercise of these rights and privileges may be restored by the Security Council.

Article 6

A Member of the United Nations which has persistently violated the Principles contained in the present Charter may be expelled from the Organization by the General Assembly upon the recommendation of the Security Council.

CHAPTER III

ORGANS

Article 7

1. There are established as the principal organs of the United Nations: a General Assembly, a Security Council, an Economic and Social Council, a Trusteeship Council, an International Court of Justice, and a Secretariat.

2. Such subsidiary organs as may be found necessary may be established in accordance with the present Charter.

Article 8

The United Nations shall place no restrictions on the eligibility of men and women to participate in any capacity and under conditions of equality in its principal and subsidiary organs.

CHAPTER IV

THE GENERAL ASSEMBLY

Composition

Article 9

1. The General Assembly shall consist of all the Members of the United Nations.

2. Each member shall have not more than five representatives in the General Assembly.

Functions and Powers

Article 10

The General Assembly may discuss any questions or any matters within the scope of the present Charter or relating to the powers and functions of any organs provided for in the present Charter, and, except as provided in Article 12, may make recommendations to the Members of the United Nations or to the Security Council or to both on any such questions or matters.

Article 11

1. The General Assembly may consider the general principles of cooperation in the maintenance of international peace and security, including the principles governing disarmament and the regulation of armaments, and may make recommendations with regard to such principles to the Members or to the Security Council or to both.

2. The General Assembly may discuss any questions relating to the maintenance of international peace and security brought before it by any Member of the United Nations, or by the Security Council, or by a state which is not a Member of the United Nations in accordance with Article 35, paragraph 2, and, except as provided in Article 12, may make recommendations with regard to any such questions to the state or states concerned or to the Security Council or to both. Any such question on which action is necessary shall be referred to the Security Council by the General Assembly either before or after discussion.

3. The General Assembly may call the attention of the Security Council to situations which are likely to endanger international peace and security.

4. The powers of the General Assembly set forth in this Article shall not limit the general scope of Article 10.

Article 12

1. While the Security Council is exercising in respect of any dispute or situation the functions assigned to it in the present Charter, the General Assembly shall not make any recommendation with regard to that dispute or situation unless the Security Council so requests.

2. The Secretary-General, with the consent of the Security Council, shall notify the General Assembly at each session of any matters relative to the maintenance of international peace and security which are being dealt with by the Security Council and shall similarly notify the General Assembly, or the Members of the United Nations if the General Assembly is not in session, immediately the Security Council ceases to deal with such matters.

Article 13

1. The General Assembly shall initiate studies and make recommendations for the purpose of:

a. promoting international cooperation in the political field and encouraging the progressive development of international law and its codification;

b. promoting international cooperation in the economic, social, cultural, educational, and health fields, and assisting in the realization of human rights and fundamental freedoms for all without distinction as to race, sex, language, or religion.

2. The further responsibilities, functions and powers of the General Assembly with respect to matters mentioned in paragraph 1(b) above are set forth in Chapters IX and X.

Article 14

Subject to the provisions of Article 12, the General Assembly may recommend measures for the peaceful adjustment of any situation, regardless of origin, which it deems likely to impair the general welfare or friendly relations among nations, including situations resulting from a violation of the provisions of the present Charter setting forth the Purposes and Principles of the United Nations.

Article 15

1. The General Assembly shall receive and consider annual and special reports from the Security Council; these reports shall include an account of the measures that the Security Council has decided upon or taken to maintain international peace and security.

2. The General Assembly shall receive and consider reports from the other organs of the United Nations.

Article 16

The General Assembly shall perform such functions with respect to the international trusteeship system as are assigned to it under Chapters XII and XIII, including the approval of the trusteeship agreements for areas not designated as strategic.

Article 17

1. The General Assembly shall consider and approve the budget of the Organization.

2. The expenses of the Organization shall be borne by the Members as apportioned by the General Assembly.

3. The General Assembly shall consider and approve any financial and budgetary arrangements with specialized agencies referred to in Article 57 and shall examine the administrative budgets of such specialized agencies with a view to making recommendations to the agencies concerned.

Voting

Article 18

1. Each member of the General Assembly shall have one vote.

2. Decisions of the General Assembly on important questions shall be made by a two-thirds majority of the members present and voting. These questions shall include: recommendations with respect to the maintenance of international peace and security, the election of the non-permanent members of the Security Council, the election of the members of the Economic and Social Council, the election of members of the Trusteeship Council in accordance with paragraph 1(c) of Article 86, the admission of new Members to the United Nations, the suspension of the rights and privileges of membership, the expulsion of Members, questions relating to the operation of the trusteeship system, and budgetary questions.

3. Decisions on other questions, Composition including the determination of additional categories of questions to be decided by a two-thirds majority, shall be made by a majority of the members present and voting.

Article 19

A Member of the United Nations which is in arrears in the payment of its financial contributions to the Organization shall have no vote in the General Assembly if the amount of its arrears equals or exceeds the amount of the contributions due from it for the preceding two full years. The General Assembly may, nevertheless, permit such a Member to vote if it is satisfied that the failure to pay is due to conditions beyond the control of the Member.

Procedure

Article 20

The General Assembly shall meet in regular annual sessions and in such special sessions as occasion may require. Special sessions shall be convoked by the Secretary-General at the request of the Security Council or of a majority of the Members of the United Nations.

Article 21

The General Assembly shall adopt its own rules of procedure. It shall elect its President for each session.

Article 22

The General Assembly may establish such subsidiary organs as it deems necessary for the performance of its functions.

CHAPTER V

THE SECURITY COUNCIL

Article 23

1. The Security Council shall consist of fifteen Members of the United Nations. The Republic of China, France, the Union of Soviet Socialist Republics, the United Kingdom of Great Britain and Northern Ireland, and the United States of America shall be permanent members of the Security Council. The General Assembly shall elect ten other Members of the United Nations to be non-permanent members of the Security Council, due regard being specially paid, in the first instance to the contribution of Members of the United Nations to the maintenance of international peace and security and to the other purposes of the Organization, and also to equitable geographical distribution.

2. The non-permanent members of the Security Council shall be elected for a term of two years. In the first election of the non-permanent members after the increase of the membership of the Security Council from eleven to fifteen, two of the four additional members shall be chosen for a term of one year. A retiring member shall not be eligible for immediate re-election.

3. Each member of the Security Council shall have one representative.

Functions and Powers

Article 24

1. In order to ensure prompt and effective action by the United Nations, its Members confer on the Security Council primary responsibility for the maintenance of international peace and security, and agree that in carrying out its duties under this responsibility the Security Council acts on their behalf.

2. In discharging these duties the Security Council shall act in accordance with the Purposes and Principles of the United Nations. The specific powers granted to the Security Council for the discharge of these duties are laid down in Chapters VI, VII, VIII, and XII.

3. The Security Council shall submit annual and, when necessary, special reports to the General Assembly for its consideration.

Article 25

The Members of the United Nations agree to accept and carry out the decisions of the Security Council in accordance with the present Charter.

Article 26

In order to promote the establishment and maintenance of international peace and security with the least diversion for armaments of the world's human and economic resources, the Security Council shall be responsible for formulating, with the assistance of the Military Staff Committee referred to in Article 47, plans to be submitted to the Members of the United Nations for the establishment of a system for the regulation of armaments.

Voting

Article 27

1. Each member of the Security Council shall have one vote.

2. Decisions of the Security Council on procedural matters shall be made by an affirmative vote of nine members.

3. Decisions of the Security Council on all other matters shall be made by an affirmative vote of nine members including the concurring votes of the permanent members; provided that, in decisions under Chapter VI, and under paragraph 3 of Article 52, a party to a dispute shall abstain from voting.

Procedure

Article 28

1. The Security Council shall be so organized as to be able to function continuously. Each member of the Security Council shall for this purpose be represented at all times at the seat of the Organization.

2. The Security Council shall hold periodic meetings at which each of its members may, if it so desires, be represented by a member of the government or by some other specially designated representative.

3. The Security Council may hold meetings at such places other than the seat of the Organization as in its judgment will best facilitate its work.

Article 29

The Security Council may establish such subsidiary organs as it deems necessary for the performance of its functions.

Article 30

The Security Council shall adopt its own rules of procedure, including the method of selecting its President.

Article 31

Any Member of the United Nations which is not a member of the Security Council may participate, without vote, in the discussion of any question brought before the Security Council whenever the latter considers that the interests of that Member are specially affected.

Article 32

Any Member of the United Nations which is not a member of the Security Council or any state which is not a Member of the United Nations, if it is a party to a dispute under consideration by the Security Council, shall be invited to participate, without vote, in the discussion relating to the dispute. The Security Council shall lay down such conditions as it deems just for the participation of a state which is not a Member of the United Nations.

CHAPTER VI

PACIFIC SETTLEMENT OF DISPUTES

Article 33

1. The parties to any dispute, the continuance of which is likely to endanger the maintenance of international peace and security, shall, first of all, seek a solution by negotiation, enquiry, mediation, conciliation, arbitration, judicial settlement, resort to regional agencies or arrangements, or other peaceful means of their own choice.

2. The Security Council shall, when it deems necessary, call upon the parties to settle their dispute by such means.

Article 34

The Security Council may investigate any dispute, or any situation which might lead to international friction or give rise to a dispute, in order to determine whether the continuance of the dispute or situation is likely to endanger the maintenance of international peace and security.

Article 35

1. Any Member of the United Nations may bring any dispute, or any situation of the nature referred to in Article 34, to the attention of the Security Council or of the General Assembly.

2. A state which is not a Member of the United Nations may bring to the attention of the Security Council or of the General Assembly any dispute to which it is a party if it accepts in advance, for the purposes of the dispute, the obligations of pacific settlement provided in the present Charter.

3. The proceedings of the General Assembly in respect of matters brought to its attention under this Article will be subject to the provisions of Articles 11 and 12.

Article 36

1. The Security Council may, at any stage of a dispute of the nature referred to in Article 33 or of a situation of like nature, recommend appropriate procedures or methods of adjustment.

2. The Security Council should take into consideration any procedures for the settlement of the dispute which have already been adopted by the parties.

3. In making recommendations under this Article the Security Council should also take into consideration that legal disputes should as a general rule be referred by the parties to the International Court of Justice in accordance with the provisions of the Statute of the Court.

Article 37

1. Should the parties to a dispute of the nature referred to in Article 33 fail to settle it by the means indicated in that Article, they shall refer it to the Security Council.

2. If the Security Council deems that the continuance of the dispute is in fact likely to endanger the maintenance of international peace and security, it shall decide whether to take action under Article 36 or to recommend such terms of settlement as it may consider appropriate.

Article 38

Without prejudice to the provisions of Articles 33 to 37, the Security Council may, if all the parties to any dispute so request, make recommendations to the parties with a view to a pacific settlement of the dispute.

CHAPTER VII

ACTION WITH RESPECT TO THREATS TO THE PEACE, BREACHES OF THE
PEACE, AND ACTS OF AGGRESSION

Article 39

The Security Council shall determine the existence of any threat to the peace, breach of the peace, or act of aggression and shall make recommendations, or decide what measures shall be taken in accordance with Articles 41 and 42, to maintain or restore international peace and security.

Article 40

In order to prevent an aggravation of the situation, the Security Council may, before making the recommendations or deciding upon the measures provided for in Article 39, call upon the parties concerned to comply with such provisional measures as it deems necessary or desirable. Such provisional measures shall be without prejudice to the rights, claims, or position of the parties concerned. The Security Council shall duly take account of failure to comply with such provisional measures.

Article 41

The Security Council may decide what measures not involving the use of armed force are to be employed to give effect to its decisions, and it may call upon the Members of the United Nations to apply such measures.

These may include complete or partial interruption of economic relations and of rail, sea, air, postal, telegraphic, radio, and other means of communication, and the severance of diplomatic relations.

Article 42

Should the Security Council consider that measures provided for in Article 41 would be inadequate or have proved to be inadequate, it may take such action by air, sea, or land forces as may be necessary to maintain or restore international peace and security. Such action may include demonstrations, blockade, and other operations by air, sea, or land forces of Members of the United Nations.

Article 43

1. All Members of the United Nations, in order to contribute to the maintenance of international peace and security, undertake to make available to the Security Council, on its call and in accordance with a special agreement or agreements, armed forces, assistance, and facilities, including rights of passage, necessary for the purpose of maintaining international peace and security.

2. Such agreement or agreements shall govern the numbers and types of forces. their degree of readiness and general location, and the nature of the facilities and assistance to be provided.

3. The agreement or agreements shall be negotiated as soon as possible on the initiative of the Security Council.

They shall be concluded between the Security Council and Members or between the Security Council and groups of Members and shall be subject to ratification by the signatory states in accordance with their respective constitutional processes.

Article 44

When the Security Council has decided to use force it shall, before calling upon a Member not represented on it to provide armed forces in fulfillment of the obligations assumed under Article 43, invite that Member, if the Member so desires, to participate in the decisions of the Security Council concerning the employment of contingents of that Member's armed forces.

Article 45

In order to enable the United Nations to take urgent military measures Members shall hold immediately available national air-force contingents for combined international enforcement action. The strength and degree of readiness of these contingents and plans for their combined action shall be determined, within the limits laid down in the special agreement or agreements referred to in Article 43, by the Security Council with the assistance of the Military Staff Committee.

Article 46

Plans for the application of armed force shall be made by the Security Council with the assistance of the Military Staff Committee.

Article 47

1. There shall be established a Military Staff Committee to advise and assist the Security Council on all questions relating to the Security Council's military requirements for the maintenance of international peace and security, the employment and command of forces placed at its disposal, the regulation of armaments, and possible disarmament.

2. The Military Staff Committee shall consist of the Chiefs of Staff of the permanent members of the Security Council or their representatives. Any Member of the United Nations not permanently represented on the Committee shall be invited by the Committee to be associated with it when the efficient discharge of the Committee's responsibilities requires the participation of that Member in its work.

3. The Military Staff Committee shall be responsible under the Security Council for the strategic direction of any armed forces placed at the disposal of the Security Council. Questions relating to the command of such forces shall be worked out subsequently.

4. The Military Staff Committee, with the authorization of the Security Council and after consultation with appropriate regional agencies, may establish regional subcommittees.

Article 48

1. The action required to carry out the decisions of the Security Council for the maintenance of international peace and security shall be taken by all the Members of the United Nations or by some of them, as the Security Council may determine.

2. Such decisions shall be carried out by the Members of the United Nations directly and through their action in the appropriate international agencies of which they are members.

Article 49

The Members of the United Nations shall join in affording mutual assistance in carrying out the measures decided upon by the Security Council.

Article 50

If preventive or enforcement measures against any state are taken by the Security Council, any other state, whether a Member of the United Nations or not, which finds itself confronted with special economic problems arising from the carrying out of those measures shall have the right to consult the Security Council with regard to a solution of those problems.

Article 51

Nothing in the present Charter shall impair the inherent right of individual or collective self-defense if an armed attack occurs against a Member of the United Nations, until the Security Council has taken measures necessary to maintain international peace and security. Measures taken by Members in the exercise of this right of selfdefense shall be immediately reported to the Security Council and shall not in any way affect the authority and responsibility of the Security Council under the present Charter to take at any time such action as it deems necessary in order to maintain or restore international peace and security.

CHAPTER VIII

REGIONAL ARRANGEMENTS

Article 52

1. Nothing in the present Charter precludes the existence of regional arrangements or agencies for dealing with such matters relating to the maintenance of international peace and security as are appropriate for regional action, provided that such arrangements or agencies and their activities are consistent with the Purposes and Principles of the United Nations.

2. The Members of the United Nations entering into such arrangements or constituting such agencies shall make every effort to achieve pacific settlement of local disputes through such regional arrangements or by such regional agencies before referring them to the Security Council.

3. The Security Council shall encourage the development of pacific settlement of local disputes through such regional arrangements or by such regional agencies either on the initiative of the states concerned or by reference from the Security Council.

4. This Article in no way impairs the application of Articles 34 and 35.

Article 53

1. The Security Council shall, where appropriate, utilize such regional arrangements or agencies for enforcement action under its authority. But no enforcement action shall be taken under regional arrangements or by regional agencies without the authorization of the Security Council, with the exception of measures against any enemy state, as defined in paragraph 2 of this Article, provided for pursuant to Article 107 or in regional arrangements directed against renewal of aggressive policy on the part of any such state, until such time as the Organization may, on request of the Governments concerned, be charged with the responsibility for preventing further aggression by such a state.

2. The term enemy state as used in paragraph 1 of this Article applies to any state which during the Second World War has been an enemy of any signatory of the present Charter.

Article 54

The Security Council shall at all times be kept fully informed of activities undertaken or in contemplation under regional arrangements or by regional agencies for the maintenance of international peace and security.

CHAPTER IX

INTERNATIONAL ECONOMIC AND SOCIAL CO-OPERATION

Article 55

With a view to the creation of conditions of stability and well-being which are necessary for peaceful and friendly relations among nations based on respect for the principle of equal rights and self-determination of peoples, the United Nations shall promote:

a. higher standards of living, full employment, and conditions of economic and social progress and development;

b. solutions of international economic, social, health, and related problems; and international cultural and educational co-operation; and

c. universal respect for, and observance of, human rights and fundamental freedoms for all without distinction as to race, sex, language, or religion.

Article 56

All Members pledge themselves to take joint and separate action in cooperation with the Organization for the achievement of the purposes set forth in Article 55.

Article 57

1. The various specialized agencies, established by intergovernmental agreement and having wide international responsibilities, as defined in their basic instruments, in economic, social, cultural, educational, health, and related fields, shall be brought into relationship with the United Nations in accordance with the provisions of Article 63.

2. Such agencies thus brought into relationship with the United Nations are hereinafter referred to as specialized agencies.

Article 58

The Organization shall make recommendations for the coordination of the policies and activities of the specialized agencies.

Article 59

The Organization shall, where appropriate, initiate negotiations among the states concerned for the creation of any new specialized agencies required for the accomplishment of the purposes set forth in Article 55.

Article 60

Responsibility for the discharge of the functions of the Organization set forth in this Chapter shall be vested in the General Assembly and, under the authority of the General Assembly, in the Economic and Social Council, which shall have for this purpose the powers set forth in Chapter X.

CHAPTER X

THE ECONOMIC AND SOCIAL COUNCIL

Composition

Article 61

1. The Economic and Social Council shall consist of fifty-four Members of the United Nations elected by the General Assembly.

2. Subject to the provisions of paragraph 3, eighteen members of the Economic and Social Council shall be elected each year for a term of three years. A retiring member shall be eligible for immediate re-election.

3. At the first election after the increase in the membership of the Economic and Social Council from twentyseven to fifty-four members, in addition to the members elected in place of the nine members whose term of office expires at the end of that year, twenty-seven additional members shall be elected. Of these twenty-seven additional members, the term of office of nine members so elected shall expire at the end of one year, and of nine other members at the end of two years, in accordance with arrangements made by the General Assembly.

4. Each member of the Economic and Social Council shall have one representative.

Functions and Powers

Article 62

1. The Economic and Social Council may make or initiate studies and reports with respect to international economic, social, cultural, educational, health, and related matters and may make recommendations with respect to any such matters to the General Assembly, to the Members of the United Nations, and to the specialized agencies concerned.

2. It may make recommendations for the purpose of promoting respect for, and observance of, human rights and fundamental freedoms for all.

3. It may prepare draft conventions for submission to the General Assembly, with respect to matters falling within its competence.

4. It may call, in accordance with the rules prescribed by the United Nations, international conferences on matters falling within its competence.

Article 63

1. The Economic and Social Council may enter into agreements with any of the agencies referred to in Article 57, defining the terms on which the agency concerned shall be brought into relationship with the United Nations. Such agreements shall be subject to approval by the General Assembly.

2. It may coordinate the activities of the specialized agencies through consultation with and recommendations to such agencies and through recommendations to the General Assembly and to the Members of the United Nations.

Article 64

1. The Economic and Social Council may take appropriate steps to obtain regular reports from the specialized agencies. It may make arrangements with the Members of the United Nations and with the specialized agencies to obtain reports on the steps taken to give effect to its own recommendations and to recommendations on matters falling within its competence made by the General Assembly.

2. It may communicate its observations on these reports to the General Assembly.

Article 65

The Economic and Social Council may furnish information to the Security Council and shall assist the Security Council upon its request.

Article 66

1. The Economic and Social Council shall perform such functions as fall within its competence in connection with the carrying out of the recommendations of the General Assembly.

2. It may, with the approval of the General Assembly, perform services at the request of Members of the United Nations and at the request of specialized agencies.

3. It shall perform such other functions as are specified elsewhere in the present Charter or as may be assigned to it by the General Assembly.

Article 67

1. Each member of the Economic and Social Council shall have one vote.

2. Decisions of the Economic and Social Council shall be made by a majority of the members present and voting.

Procedure

Article 68

The Economic and Social Council shall set up commissions in economic and social fields and for the promotion of human rights, and such other commissions as may be required for the performance of its functions.

Article 69

The Economic and Social Council shall invite any Member of the United Nations to participate, without vote, in its deliberations on any matter of particular concern to that Member.

Article 70

The Economic and Social Council may make arrangements for representatives of the specialized agencies to participate, without vote, in its deliberations and in those of the commissions established by it, and for its representatives to participate in the deliberations of the specialized agencies.

Article 71
The Economic and Social Council may make suitable arrangements for consultation with non-governmental organizations which are concerned with matters within its competence. Such arrangements may be made with international organizations and, where appropriate, with national organizations after consultation with the Member of the United Nations concerned.

Article 72

1. The Economic and Social Council shall adopt its own rules of procedure, including the method of selecting its President.

2. The Economic and Social Council shall meet as required in accordance with its rules, which shall include provision for the convening of meetings on the request of a majority of its members.

CHAPTER XI

DECLARATION REGARDING NON-SELF-GOVERNING TERRITORIES

Article 73

Members of the United Nations which have or assume responsibilities for the administration of territories whose peoples have not yet attained a full measure of self-government recognize the principle that the interests of the inhabitants of these territories are paramount, and accept as a sacred trust the obligation to promote to the utmost, within the system of international peace and security established by the present Charter, the well-being of the inhabitants of these territories, and, to this end:

a. to ensure, with due respect for the culture of the peoples concerned, their political, economic, social, and educational advancement, their just treatment, and their protection against abuses;

b. to develop self-government, to take due account of the political aspirations of the peoples, and to assist them in the progressive development of their free political institutions, according to the particular circumstances of each territory and its peoples and their varying stages of advancement;

c. to further international peace and security;

d. to promote constructive measures of development, to encourage research, and to cooperate with one another and, when and where appropriate, with specialized international bodies with a view to the practical achievement of the social, economic, and scientific purposes set forth in this Article; and

e. to transmit regularly to the Secretary-General for information purposes, subject to such limitation as security and constitutional considerations may require, statistical and other information of a technical nature relating to economic, social, and educational conditions in the territories for which they are respectively responsible other than those territories to which Chapters XII and XIII apply.

Article 74

Members of the United Nations also agree that their policy in respect of the territories to which this Chapter applies, no less than in respect of their metropolitan areas, must be based on the general principle of goodneighborliness, due account being taken of the interests and well-being of the rest of the world, in social, economic, and commercial matters.

CHAPTER XII

INTERNATIONAL TRUSTEESHIP SYSTEM

Article 75

The United Nations shall establish under its authority an international trusteeship system for the administration and supervision of such territories as may be placed thereunder by subsequent individual agreements. These territories are hereinafter referred to as trust territories.

Article 76

The basic objectives of the trusteeship system, in accordance with the Purposes of the United Nations laid down in Article 1 of the present Charter, shall be:

a. to further international peace and security;

b. to promote the political, economic, social, and educational advancement of the inhabitants of the trust territories, and their progressive development towards self-government or independence as may be appropriate to the particular circumstances of each territory and its peoples and the freely expressed wishes of the peoples concerned, and as may be provided by the terms of each trusteeship agreement;

c. to encourage respect for human rights and for fundamental freedoms for all without distinction as to race, sex, language, or religion, and to encourage recognition of the interdependence of the peoples of the world; and

d. to ensure equal treatment in social, economic, and commercial matters for all Members of the United Nations and their nationals and also equal treatment for the latter in the administration of justice without prejudice to the attainment of the foregoing objectives and subject to the provisions of Article 80.

Article 77

1. The trusteeship system shall apply to such territories in the following categories as may be placed thereunder by means of trusteeship agreements:

a. territories now held under mandate;

b. territories which may be detached from enemy states as a result of the Second World War, and

c. territories voluntarily placed under the system by states responsible for their administration.

2. It will be a matter for subsequent agreement as to which territories in the foregoing categories will be brought under the trusteeship system and upon what terms.

Article 78

The trusteeship system shall not apply to territories which have become Members of the United Nations, relationship among which shall be based on respect for the principle of sovereign equality.

Article 79

The terms of trusteeship for each territory to be placed under the trusteeship system, including any alteration or amendment, shall be agreed upon by the states directly concerned, including the mandatory power in the case of territories held under mandate by a Member of the United Nations, and shall be approved as provided for in Articles 83 and 85.

Article 80

1. Except as may be agreed upon in individual trusteeship agreements, made under Articles 77, 79, and 81, placing each territory under the trusteeship system, and until such agreements have been concluded, nothing in this Chapter shall be construed in or of itself to alter in any manner the rights whatsoever of any states or any peoples or the terms of existing international instruments to which Members of the United Nations may respectively be parties.

2. Paragraph 1 of this Article shall not be interpreted as giving grounds for delay or postponement of the negotiation and conclusion of agreements for placing mandated and other territories under the trusteeship system as provided for in Article 77.

Article 81

The trusteeship agreement shall in each case include the terms under which the trust territory will be administered and designate the authority which will exercise the administration of the trust territory. Such authority, hereinafter called the administering authority, may be one or more states or the Organization itself.

Article 82

There may be designated, in any trusteeship agreement, a strategic area or areas which may include part or all of the trust territory to which the agreement applies, without prejudice to any special agreement or agreements made under Article 43.

Article 83

1. All functions of the United Nations relating to strategic areas, including the approval of the terms of the trusteeship agreements and of their alteration or amendment, shall be exercised by the Security Council.

2. The basic objectives set forth in Article 76 shall be applicable to the people of each strategic area.

3. The Security Council shall, subject to the provisions of the trusteeship agreements and without prejudice to security considerations, avail itself of the assistance of the Trusteeship Council to perform those functions of the United Nations under the trusteeship system relating to political. economic, social, and educational matters in the strategic areas.

Article 84

It shall be the duty of the administering authority to ensure that the trust territory shall play its part in the maintenance of international peace and security. To this end the administering authority may make use of volunteer forces, facilities, and assistance from the trust territory in carrying out the obligations towards the Security Council undertaken in this regard by the administering authority, as well as for local defense and the maintenance of law and order within the trust territory.

Article 85

1. The functions of the United Nations with regard to trusteeship agreements for all areas not designated as strategic, including the approval of the terms of the trusteeship agreements and of their alteration or amendment, shall be exercised by the General Assembly.

2. The Trusteeship Council, operating under the authority of the General Assembly, shall assist the General Assembly in carrying out these functions.

CHAPTER XIII

THE TRUSTEESHIP COUNCIL

Composition

Article 86

1. The Trusteeship Council shall consist of the following Members of the United Nations:

a. those Members administering trust territories;

b. such of those Members mentioned by name in Article 23 as are not administering trust territories; and

c. as many other Members elected for three-year terms by the General Assembly as may be necessary to ensure that the total number of members of the Trusteeship Council is equally divided between those Members of the United Nations which administer trust territories and those which do not.

2. Each member of the Trusteeship Council shall designate one specially qualified person to represent it therein.

Functions and Powers

Article 87

The General Assembly and, under its authority, the Trusteeship Council, in carrying out their functions, may:

a. consider reports submitted by the administering authority;

b. accept petitions and examine them in consultation with the administering authority;

c. provide for periodic visits to the respective trust territories at times agreed upon with the administering authority; and

d. take these and other actions in conformity with the terms of the trusteeship agreements.

Article 88

The Trusteeship Council shall formulate a questionnaire on the political, economic, social, and educational advancement of the inhabitants of each trust territory, and the administering authority for each trust territory within the competence of the General Assembly shall make an annual report to the General Assembly upon the basis of such questionnaire.

Voting

Article 89

1. Each member of the Trusteeship Council shall have one vote.

2. Decisions of the Trusteeship Council shall be made by a majority of the members present and voting.

Procedure

Article 90

1. The Trusteeship Council shall adopt its own rules of procedure, including the method of selecting its President.

2. The Trusteeship Council shall meet as required in accordance with its rules, which shall include provision for the convening of meetings on the request of a majority of its members.

Article 91

The Trusteeship Council shall, when appropriate, avail itself of the assistance of the Economic and Social Council and of the specialized agencies in regard to matters with which they are respectively concerned.

CHAPTER XIV

THE INTERNATIONAL COURT OF JUSTICE

Article 92

The International Court of Justice shall be the principal judicial organ of the United Nations. It shall function in accordance with the annexed Statute which is based upon the Statute of the Permanent Court of International Justice and forms an integral part of the present Charter.

Article 93

1. All Members of the United Nations are ipso facto parties to the Statute of the International Court of Justice.

2. A state which is not a Member of the United Nations may become a party to the Statute of the International Court of Justice on conditions to be determined in each case by the General Assembly upon the recommendation of the Security Council.

Article 94

1. Each Member of the United Nations undertakes to comply with the decision of the International Court of Justice in any case to which it is a party.

2. If any party to a case fails to perform the obligations incumbent upon it under a judgment rendered by the Court, the other party may have recourse to the Security Council, which may, if it deems necessary, make recommendations or decide upon measures to be taken to give effect to the judgment.

Article 95

Nothing in the present Charter shall prevent Members of the United Nations from entrusting the solution of their differences to other tribunals by virtue of agreements already in existence or which may be concluded in the future.

Article 96

1. The General Assembly or the Security Council may request the International Court of Justice to give an advisory opinion on any legal question.

2. Other organs of the United Nations and specialized agencies, which may at any time be so authorized by the General Assembly, may also request advisory opinions of the Court on legal questions arising within the scope of their activities.

CHAPTER XV

THE SECRETARIAT

Article 97

The Secretariat shall comprise a Secretary-General and such staff as the Organization may require. The Secretary-General shall be appointed by the General Assembly upon the recommendation of the Security Council. He shall be the chief administrative officer of the Organization.

Article 98

The Secretary-General shall act in that capacity in all meetings of the General Assembly, of the Security Council, of the Economic and Social Council, and of the Trusteeship Council, and shall perform such other functions as are entrusted to him by these organs. The Secretary-General shall make an annual report to the General Assembly on the work of the Organization.

Article 99

The Secretary-General may bring to the attention of the Security Council any matter which in his opinion may threaten the maintenance of international peace and security.

Article 100

1. In the performance of their duties the Secretary-General and the staff shall not seek or receive instructions from any government or from any other authority external to the Organization. They shall refrain from any action which might reflect on their position as international officials responsible only to the Organization.

2. Each Member of the United Nations undertakes to respect the exclusively international character of the responsibilities of the Secretary-General and the staff and not to seek to influence them in the discharge of their responsibilities.

Article 101

1. The staff shall be appointed by the Secretary-General under regulations established by the General Assembly.

2. Appropriate staffs shall be permanently assigned to the Economic and Social Council, the Trusteeship Council, and, as required, to other organs of the United Nations. These staffs shall form a part of the Secretariat.

3. The paramount consideration in the employment of the staff and in the determination of the conditions of service shall be the necessity of securing the highest standards of efficiency, competence, and integrity. Due regard shall be paid to the importance of recruiting the staff on as wide a geographical basis as possible.

CHAPTER XVI

MISCELLANEOUS PROVISIONS

Article 102

1. Every treaty and every international agreement entered into by any Member of the United Nations after the present Charter comes into force shall as soon as possible be registered with the Secretariat and published by it.

2. No party to any such treaty or international agreement which has not been registered in accordance with the provisions of paragraph I of this Article may invoke that treaty or agreement before any organ of the United Nations.

Article 103

In the event of a conflict between the obligations of the Members of the United Nations under the present Charter and their obligations under any other international agreement, their obligations under the present Charter shall prevail.

Article 104
The Organization shall enjoy in the territory of each of its Members such legal capacity as may be necessary for the exercise of its functions and the fulfillment of its purposes.

Article 105

1. The Organization shall enjoy in the territory of each of its Members such privileges and immunities as are necessary for the fulfillment of its purposes.

2. Representatives of the Members of the United Nations and officials of the Organization shall similarly enjoy such privileges and immunities as are necessary for the independent exercise of their functions in connection with the Organization.

3. The General Assembly may make recommendations with a view to determining the details of the application of paragraphs 1 and 2 of this Article or may propose conventions to the Members of the United Nations for this purpose.

CHAPTER XVII

TRANSITIONAL SECURITY ARRANGEMENTS

Article 106

Pending the coming into force of such special agreements referred to in Article 43 as in the opinion of the Security Council enable it to begin the exercise of its responsibilities under Article 42, the parties to the Four-Nation Declaration, signed at Moscow October 30, 1943, and France, shall, in accordance with the provisions of paragraph 5 of that Declaration, consult with one another and as occasion requires with other Members of the United Nations with a view to such joint action on behalf of the Organization as may be necessary for the purpose of maintaining international peace and security.

Article 107

Nothing in the present Charter shall invalidate or preclude action, in relation to any state which during the Second World War has been an enemy of any signatory to the present Charter, taken or authorized as a result of that war by the Governments having responsibility for such action.

CHAPTER XVIII

AMENDMENTS

Article 108

Amendments to the present Charter shall come into force for all Members of the United Nations when they have been adopted by a vote of two thirds of the members of the General Assembly and ratified in accordance with their respective constitutional processes by two thirds of the Members of the United Nations, including all the permanent members of the Security Council.

Article 109

1. A General Conference of the Members of the United Nations for the purpose of reviewing the present Charter may be held at a date and place to be fixed by a two-thirds vote of the members of the General Assembly and by a vote of any seven members of the Security Council. Each Member of the United Nations shall have one vote in the conference.

2. Any alteration of the present Charter recommended by a two-thirds vote of the conference shall take effect when ratified in accordance with their respective constitutional processes by two thirds of the Members of the United Nations including all the permanent members of the Security Council.

3. If such a conference has not been held before the tenth annual session of the General Assembly following the coming into force of the present Charter, the proposal to call such a conference shall be placed on the agenda of that session of the General Assembly, and the conference shall be held if so decided by a majority vote of the members of the General Assembly and by a vote of any seven members of the Security Council.

CHAPTER XIX

RATIFICATION AND SIGNATURE

Article 110

1. The present Charter shall be ratified by the signatory states in accordance with their respective constitutional processes.

2. The ratifications shall be deposited with the Government of the United States of America, which shall notify all the signatory states of each deposit as well as the Secretary-General of the Organization when he has been appointed.

3. The present Charter shall come into force upon the deposit of ratifications by the Republic of China, France, the Union of Soviet Socialist Republics, the United Kingdom of Great Britain and Northern Ireland, and the United States of America, and by a majority of the other signatory states. A protocol of the ratifications deposited shall thereupon be drawn up by the Government of the United States of America which shall communicate copies thereof to all the signatory states.

4. The states signatory to the present Charter which ratify it after it has come into force will become original Members of the United Nations on the date of the deposit of their respective ratifications.

Article 111

The present Charter, of which the Chinese, French, Russian, English, and Spanish texts are equally authentic, shall remain deposited in the archives of the Government of the United States of America. Duly certified copies thereof shall be transmitted by that Government to the Governments of the other signatory states.

IN FAITH WHEREOF the representatives of the Governments of the United Nations have signed the present Charter.

DONE at the city of San Francisco the twenty-sixth day of June, one thousand nine hundred and forty-five.

I disagree that the LTTE is solely behind all of this.

As i have discussed with Moshe (you can see the posts on the previous page) it is the West that is behind this and they are merely using the LTTE/Tamils as a conduit of interference.

By localising on one obvious factor it creates a narrow view which misses other factors that makes fighting off the real and significant threats to our nation and people incredibility difficult and unending because we are missing the real players. It is like going for the weeds on the surface and not the roots.

Essentially a new world block of third world countries that together have collective power. China and Russia would back such thing, China more because it will be good for their businesses –as they are hungry for resources across the third world. "Although a substantial normative framework had been developed for the protection of civilians, the politicization and selectivity characterizing the debate on implementation had affected its credibility, thereby calling into question the sincerity of the concerns expressed for the plight of civilians affected by armed conflict," Kohona's statement said.

"The issue could not be addressed on humanitarian terms alone, and nor could the normative framework be applied in a merely theoretical manner," the UN Ambassador noted.

The UN Ambassador told the Council that civilian displacement due to the conflict must not be politicized or turned into a theoretical problem. He called on the Council to develop a mechanism to hold non-State actors accountable as well and recognize the problems of asymmetrical conflicts.

Kohona highlighted the need to address the causes of armed conflict including the proliferation of small arms and light weapons which has contributed to the violence and terrorism.

"There was also a need to recognize the legitimate role of the military in civilian protection, though it was not an exclusive one," the representative told the Council.

Noting that although the principle of unimpeded access for humanitarian personnel must be respected, Kohona emphasized that it could not disregard the State's primary responsibility to ensure their safety and security.

"In Sri Lanka's experience, the military, often at huge cost, had had to bring civilians out of harm's way," he said, adding that military and humanitarian personnel must therefore seek to work in partnership.

UN Chief says accountability is vital in protecting civilians in armed conflicts

July 08, New York: The accountability is a core challenge in protecting civilians during armed conflicts and those who are responsible for acts of violence committed on civilians whether they are state or non-state actors should be held accountable, the United Nations Secretary-General Ban Ki-moon told the UN Security Council Wednesday (07).

"Violent crimes are not the only ones that harm civilians. Acts of omission, including the hindering of humanitarian access, can be just as, or even more, damaging. Those who create such obstacles must also be held accountable, be they State or non-State actors," the UN Chief said in his remarks to the Security Council open debate on the Protection of Civilians in Armed Conflict.

The UN Chief said the ongoing or recent events and conditions in Sri Lanka, Kyrgyzstan, Gaza, Sudan, Somalia, the Democratic Republic of the Congo, and elsewhere show that the protection of civilians remains a huge common challenge.

Citing Sri Lanka the Secretary-General said that he has appointed a panel to investigate the issue of accountability during the last phase of the war with Tamil Tigers.

"In Sri Lanka, I have emphasized the importance of an accountability process for alleged violations of human rights and humanitarian law by all sides in the conflict that ended there last year. I have appointed a Panel of Experts to advise me on these issues," he said.

Although there have been significant advances in the normative capabilities of national and international systems derived from the work of the International Criminal Court, more must be done to increase the expectation that violators will have to face the consequences of their actions, the UN Chief pointed out to the Council.

"The willful targeting of civilians, disproportionate attacks, sexual violence, forced displacement and the denial of humanitarian access remain widespread in armed conflict, often carried out with impunity," Mr. Ban told the Security Council.

Addressing the Council the High Commissioner for Human Rights Ms. Navi Pillay said the accountability of perpetrators is key for the protection of civilians.

Ms. Pillay noted that the governments bear the primary responsibility for carrying out investigations and prosecutions regarding genocide, war crimes, crimes against humanity and gross human rights violations.

Welcoming the initiatives of several countries to establish national commissions of inquiry to seek justice ms. Pillay said the true accountability can be achieved only if national inquiry mechanisms are credible, independent and impartial.

UN humanitarian chief John Holmes addressing the Council, which heard from 40 speakers, urged the Council to take a robust approach to accountability as the "conduct of parties to conflict is inevitably affected by their sense of susceptibility to punishment and accountability to their victims, and clear signals that impunity will not be tolerated.

July 08, Colombo: Sri Lanka's National Freedom Front (NFF) Leader and Housing, Construction and Engineering Services Minister Wimal Weerawansa today (08) launched a fast unto death outside the UN office in Colombo in protest over the panel of experts appointed by the UN Secretary-General.

Weerawansa and his supporters who launched the Sathyagraha outside the UN office in Colombo calling for the withdrawal of the UN Secretary General's panel of experts, today have converted it into a fast unto death.

The Minister said that the fast will continue until the panel of experts is withdrawn by the UN Chief.

Weerawansa who took part in a Pirith ceremony before speaking to reporters in the area said that he would even sacrifice his life to safeguard the soldiers who had fought the war against the LTTE.

He also urged the public to come in thousands and take part in protests and demonstrations all over the island to demand for the withdrawal of the panel of experts.

However, the UN has not given any indication that it would revoke the panel of experts. The UN spokesman made it clear yesterday that the panel will go about their work.

Elsewhere in the world these “UN people” are treated like dirt and live in fear of their host countries, worried about upsetting their host (mainly 3rd world countries) and walk a very fine line. But in Sri Lanka they are pampered and given a life style they do not deserve living out of 5 star hotels and condominiums where they have luxuries they can only dream of back in the West but have given to them on a plate under the guise of "humanitarian work" -where they thrive over our misery and perpetuating lies against this country to prolong the misery to justify their stay and luxury lives? You will also find these people have little to no qualifications and are hardly employable in whatever Western countries they originate from and would only be good for working in supermarkets stacking shelves or sweeping streets (but they speak english and have white skin! Thus must be “educated” and worshiped as per Colombian logic Hikz). They are packed off to places like Sri Lanka to live lives of luxury they do not deserve but happily take -thriving off hardships and poverty in the 3rd world countries which justify their presence enabling to drink off the “humanitarian” gravy train and have a good easy life for themselves. They are driven by selfish individualism and greed (like Colombians). Furthermore Sri Lanka is not a Sudan or Afghanistan, there are bars, hotels, night clubs, beeches, resorts, fishing trips, lakes, scuba diving and all kinds of “adventures” that are extremely safe and free for these people to enjoy. All under the name of “humanitarianism” and “helping little brown people” of course.

A deal to build a container terminal in an expanded Colombo port will be awarded to a China – Sri Lanka consortium within ‘two to three weeks’ Treasury Secretary P B Jayasundera said.

Sri Lanka’s listed Aitken Spence and China Merchant Holdings, a state-run port operator, were the only bidder for the terminal concession in July 2009 when the world was reeling from an economic slump and lower shipping traffic.

“Right now we are about to issue an LOI (letter of intent) on the development for Colombo port,” Jayasundera told an economic forum organized by the Ceylon Chamber of Commerce Wednesday.

“The concession agreement has been finalized.”

Sri Lanka Ports Authority has been haggling with the sole bidder to raise royalties paid under the concession agreement for the last year.

A team from China Merchant Holdings is now in the country and awaiting legal clearance of the concession agreement, sources close to the deal said.

Jayasundera told LBO the deal is likely to be awarded within two to three weeks.

Analysts say the terminal is likely to cost around 500 million US dollars in debt and equity. The concession agreement setting out the terms under which an operator can build and operate a container terminal is the key agreement that underpins the public private partnership (PPP).

Armed with the concession agreement, the bidders will next go for ‘financial closure’ raising debt and also injecting their own equity.

The government itself is investing around 380 million US dollars to build a breakwater with Asian Development Bank financing and expand Colombo port, which straddles an east-west shipping lane across the Indian Ocean.

The expanded breakwater has space for multiple terminals which can be built over several years as world ship traffic and trade with Asia increases.

Jayasundera said the port was a good example where donor involvement in public investment could bring in expanded private investment through PPP.

Jayasundera said he was expecting every one percent of gross domestic product of state investment to eventually kindle five times that volume in private investment and the government was pouring money into road, power, port and airports.

Richard Vokes, who represents the ADB in Colombo, said the government should ‘aggressively’ look for new PPP opportunities.

Demonstrations outside United Nations headquarters in the Sri Lankan capital, Colombo, have continued following a mass blockade, and now protest leaders say they will launch a hunger strike.

The UN has set up an advisory committee to look at alleged crimes against humanity, which could implicate the government in the deaths of reportedly thousands of Tamils in the recent war with the Tamil Tigers.

The committee has a tough job. Its three members may not even get visas to enter the country.

Sri Lankan protesters accusing the world body of pressing on their national sovereignty blockaded the headquarters on Wednesday, with staff unable to leave for several hours.

According to reports, the police initially held back protesters, but then moved away.

UN secretary general Ban Ki-moon set up the advisory panel in response to accusations of significant abuses during the final stages of the government's war against the Tigers, which ended in the Tigers' defeat last year.

The blockade was a surprise for the UN and the world body has registered its own protest with the Sri Lankan government, after what it said were previous assurances for the security of UN personnel.

Dr Jehan Perera, executive director of the non-government National Peace Council of Sri Lanka (NPCSL), says there are opposing arguments about the panel.

Some are insisting all measures should be explored to make sure that justice for violations is pursued.

He told Radio Australia's Asia Pacific program the UN action has also mobilised a nationalist response, with many people resenting it and saying it interferes in the country's sovereignty.

"[The protest] is being mobilised by the government but at the same I think it has also got the support of a majority of the people, especially the ethnic Sinhalese majority," he said.

"They are of the same view as the government, that this is a sort of witch-hunt by the international community."

Opponents of the hearings argue, he said, that much worse things, with greater casualties, have happened in countries like Iraq and Afghanistan.

The Sri Lankan government has also set up its own committee, the Lessons Learned and Reconciliation Commission, but advocacy groups such as New York-based Human Rights Watch say this commission falls short of the standards needed for accountability.

Professor Rajiva Wijesinha, a member of parliament with the Coalition government, believes many of the accusations of crimes against the government lack enough detail to be treated seriously.

"It is certainly obviously not a case of either deliberate targeting of civilians ... or prima facie evidence of carelessness," he said.

"What you people (the West) have been doing in Afghanistan ... the collateral damage is colossal compared to us."

Human rights organisations insist there is significant evidence of indiscriminate killings in the last days of the war.

Dr Perera, however, believes that the strong nationalist reaction means that at best, UN moves can only go forward very slowly.

A better chance might come with things handled "in a different way and at a different time, and with the consent of the authorities in Sri Lanka," he said.

"Perhaps this is too soon after the end of the war for Sri Lankans to look at what has happened in a calm and just manner."

"Nothing contained in the present Charter shall authorize the United Nations to intervene in matters which are essentially within the domestic jurisdiction of any state, or shall require the Members to submit such matters to settlement under the present Charter; but this principle shall not prejudice the application of enforcement measures under Chapter VII."

Since this matter does not threaten international peace, the provisions of Chapter VII do not apply to it.

Thus, Ban Ki Moon is VIOLATING the provisions of the UN's own Charter! Ban Ki Moon is doing the bidding of Powerful Western Countries who pose as the champions of human rights, and seek cover under the UN to wage wars without UN oversight in third world countries killing tens of thousands pof people on a routine basis. These champions of the campaign against terrorism, mired knee deep in Iraq and Afghanistan, are jealous of the success of Sri Lanka in eradicating the LTTE terrorism .. in one fell swoop.

Visiting Sri Lankan Tamil Alliance delegates meet Indian Foreign Minister

July 08, New Delhi: The parliamentary delegation of Sri Lanka's Tamil National Alliance (TNA) led by parliamentarian R. Sampanthan currently visiting New Delhi has met India's External Affairs Minister S.M. Krishna today.

The six-member TNA delegation had a 30 minute discussion with the Indian minister on a variety of issues related to the welfare of Tamils in Sri Lanka, focusing mainly on the resettlement process of the Internally Displaced Persons (IDPs).

The delegation sought help of the Indian government for the Tamil's cause in post-war Sri Lanka.

Indian media reported that Krishna and the TNA members discussed various dimensions and causes of the ethnic conflict in Sri Lanka, and explored plausible political solutions to resolve the refugee crisis.

Earlier, the TNA members held discussions with Home Minister P. Chidambaram and External Affairs Ministry Secretary Nirupama Rao. They also met the CPI MP D Raja yesterday and sought Indian help for a solution to the ethnic conflict in Sri Lanka.

Fasting Sri Lankan Minister stops consuming water despite requests by medical team

July 08, Colombo: Sri Lanka's National Freedom Front (NFF) Leader and Housing, Construction and Engineering Services Minister Wimal Weerawansa who is currently on a fast unto death outside the UN office in Colombo has stopped drinking water.

A NFF spokesperson has told the local media that Weerawansa had stopped consuming water amidst requests made by a medical team that had told him to continue consuming water.

The Minister commenced the fast unto death today demanding the withdrawal of the panel of experts appointed on Sri Lanka by the UN Secretary-General.

He commenced the fast after receiving the blessings of Buddhist monks in the morning and vowed to continue the fast until the panel was withdrawn.

It has become an obsession for Tamil Nadu politicians to interfere in the internal affairs of Sri Lanka despite their many urgent problems. Since late, instead of resolving these pressing issues even after three decades of Independence they continue to intrude into the internal matters of a sovereign State. This ruse conveniently adopted by Tamil Nadu politicians is not confined to only taking such uncalled swipes at Sri Lanka but also extends to offer advice on Sri Lankan internal affairs seems an attempt to deflect burning issues in Tamil Nadu. It is true that Tamil Nadu has a population of over 60 million people who have claimed affinities to the Sri Lankan Tamils in race, religion, culture and proximity. However, Tamil Nadu politicians should by now understand that Sri Lanka is "insulated" though not "isolated" from the sub continent regards race language, religion, culture and proximity .

The Indian English media recently reported that the AIADMK leader Ms Jayalalitha Jayaram had stated that the Tamil community in Sri Lanka would benefit by the threatened UN "investigations" into lapses in the final stages of eliminating the LTTE leadership almost in its entirety in Mid May 2009. His Excellency, President Mahinda Rajapaksa as reiterated clearly that no such UN investigations are required There were other Tamil Nadu political leaders as the MDMK leader "Vaiko" who proclaimed there will be "rivers of blood" if the LTTE leader was harmed and even the disintegration of the Union. There was of course the aging DMK Chief M K Karunanidhi who began a fast unto death near the "Anna" memorial armed with air conditioners if India did not demand an "immediate ceasefire" to the ongoing humanitarian operations conducted against the LTTE terrorists. This " fast unto death" fizzled out as expected after just three hours with the stating that he was assured his demand were accepted. Tamil Nadu political leaders are under the delusion that Sri Lankan Tamils are their own citizens which they are not only to ensure their "vote banks" by keeping alive not only the demand for separatism for the Sri Lankan Tamils but also dreams of separatism alive Tamil Nadu .

Last year "The Hindu" reported that the Welfare Camps established in Menik Farm, Vavuniya were far better than the Camps for Sri Lankan Tamil refugees set up in Tamil Nadu nearly three decades ago. DMK Chief Minister M K Karunanidhi was also "christened " leader of the Tamil people as requested by speakers from "Tamil Nadu and other countries" suggesting that he "take on the responsibility of protecting the Tamil people wherever they lived" giving a "new dimension to the Sri Lankan Tamil problem". "It has now become the part of safeguarding the Tamil language". The danger lies in including the entire Tamil Diaspora. The Chief Minister also suggested in a resolution which called on the Indian Central Government to adopt "all the official languages of the Indian states as the Indian official languages". "If that is accepted", says the writer,"the process of reshaping India where the hold of the Central Government would slacken would be initiated". Despite much agitation since 1950 especially by Tamil Nadu to include Tamil, "Hindi and English continue to be the official languages of India".

Tea trade between Sri Lanka and Ukraine is gearing up for good times ahead with positive response received at the discussions conducted marking the visit of President Mahinda Rajapaksa to Ukraine last week.

Chairman of the Tea Exporters' Association, Jayantha Keragala told the Daily FT yesterday that discussions with tea traders in Ukraine yielded positive response on the line of duty concessions. He stated that President Rajapaksa during the discussions with the Ukraine authorities requested a reduction in duty or a concession on packed goods for which a favourable response was received.

"All discussions concluded favourably although there was no specific agreement. Sri Lanka plays a key role in the Ukraine market in the tea sector and as at now a 10 per cent duty on the gross weight of packaged teas is being charged on local teas exported," Keragala said. "Due to this value addition takes a beating."

As pointed out at the discussions, if the duty is removed, tea exports to Ukraine are bound to witness a surge. Keragala stated that quantity wise Sri Lanka exports 4.3 million kilos annually to the Ukraine direct. "It is the better teas that reach the Ukraine market. In addition another batch also reaches the country though the CIS countries such as Uzbekistan." With a population of 48 million, the tea consumption of the region amounts to an approximate eight to 10 million kilos annually. "Out of the 4.3 million kilos of Ceylon tea that goes to Ukraine 50 per cent goes as bulk and 50 per cent goes as value addition.

The Ukraine market has seen a decline compared to previous years, and with the new duty cut we hope we will be able to enter the market with more force and increased numbers," he said.

The total production of tea in Sri Lanka shows favorable signs this year with almost 30 million kilos of production identified within the first six months of the year. The numbers are expected to further increase over the next six months.

On behalf of Sri Lanka Chamber of Commerce, Keragala signed an agreement with the Ukraine Chamber of Commerce on general trade facilities and various other trading facilities. He asserted that the entire trip took a positive turn with almost all representatives of the various trades receiving thumbs up on diverse subject matters. Beauty care products, natural cosmetic products, shipping and other industries were mentioned as matters that received a favourable reply.

COLOMBO: Sri Lankan Housing Minister, Wimal Weerawansa, on Thursday began a fast unto death in front of the UN office in Colombo, demanding that the UN Secretary General, Ban Ki-moon, dissolve the expert panel he had appointed to advice him on human rights issues in Sri Lanka.

Minister Weerawansa underwent a Buddhist pirith ceremony before he began the fast. He said he was ready to sacrifice his life to safeguard the soliders who had fought the war against the LTTE. He would never allow the UN or any other body to question the wisdom of the army action against the LTTE, as it had brought the country peace after three decades of suffering.

Weerawansa said that he did not mind being sacked from the government, if the latter did not approve of his action.

He appealed to the public to take part in thousands in protests and demonstrations all over the island in order to preassurise the UN Secretary General to dissolve the panel on Sri Lanka.

The three other National Freedom Front (NFF) volunteers who were staging a fast for the last two days, broke it, allowing Weerawansa to go solo. Since a cabinet minister was fasting, the busy Bauddhaloka Mawatha was closed to traffic, and troops and gun toting police were deployed.

Why escalation?

Political circles explained the sudden escalation of the protest over the UN panel saying that Sri Lanka had come to know that the panel was going to begin its work in the third week of July and would work feverishly to submit its report in four months’ time.

The report is expected to be highly critical of Sri Lanka, especially the conduct of its armed forces in the last phase of the war against the Tamil Tigers in April-May 2009.

UN staff asked to stay at home

UN staff told Express that they had been asked to not to come to work on Friday, the last working day of the week. Any decision regarding the coming week would be taken only after a review at the end of this week, they said.

Attendance had been thin since Wednesday. On Tuesday the agitators had confined the 125 members of the staff for six hours till the police intervened. The next day, they sat on a dharna but alowed the staff to go in and out. However, only a few attended office, the rest having been asked to work from home.

Government seeks end to crisis

The Minister of External Affairs, G.L.Peiris, told the media that the government could not dissallow any peaceful protest in front of the UN office. However, he admitted that there was a crisis, and that the government was working towards a “speedy end to it.”

Opposition against fast

The opposition United National Party (UNP) has expressed itself against the fast. UNP Deputy Leader, Karu Jayasuriya, said that Weerawansa's fast was meaningless because there was absolutely no danger of a war crimes tribunal going into the conduct of the war in Sri Lanka.

Sri Lanka, he said, could not be brought before the International War Crimes Tribunal because it had not ratified the Rome Statute on the International Criminal Court (ICC).

Jayasuriya reminded the agitators that it was a UNP government led by Prime Minister Ranil Wickremesinghe, which had decided not to sign the Rome Statute when there was pressure to do so in 2002.

My understanding is that at the time Serbia was attacked by UN/NATO forces over the Kosovo issue, Serbia was

1. a sovereign UN member state under the UN Charter, and

2. was not a signatory to the Rome statute.

As such, the UN approved attack was illegal.

After the attack, and the implementation of embargoes on Serbia, Serbian will collapsed internally, and they ousted Milosevich and his crew to comply with the attackers demands. That "regime change" was the desired goal of the attackers.

After the regime change, the new regime was prevailed upon to sign the Rome statute. THEREAFTER, Serbia is bound by the Rome statute, but Serbia's actions prior to that signing was not so bound.

It is a FUNDAMENTAL UNIVERSALLY ACCEPTED TENET OF LAW that laws cannot be applied to individuals, or to nations, RETROACTIVELY to hold them responsible for criminal wrongdoing in the past. UN panel is an opportunity for Sri Lanka to hold an accountable process

July 09, Colombo: The United States Thursday said the expert panel appointed by the United Nations Secretary-General to advise him on Sri Lanka's alleged human right violations is an opportunity for Sri Lanka to hold an accountable process and Sri Lanka should take advantage of the experts panel.

Responding to media queries on the indefinite hunger strike launched by a Sri Lankan cabinet minister outside the UN office in Colombo, acting deputy spokesman of the State Department Mark Toner reiterated the US stance of supporting the panel.

"We feel like it's in Sri Lanka's best interest to accept these people and their expert advice and that's offered in good faith," Toner said.

The spokesman said he cannot speak for the UN and resolving the ongoing confrontation between the UN and Sri Lanka is a matter for the parties involved.

"But in terms of the UN group, we support their involvement," he said.

The UN Secretary-General Ban Ki-moon Thursday recalled its Resident Coordinator in Sri Lanka Neil Buhne to New York for consultations and announced that the United Nations Development Programme (UNDP) as the Sri Lankan government has failed to resolve the issue.

The UN chief has insisted that the panel appointed by him to probe the alleged violations of human rights and humanitarian laws during the late stages of the war with Tamil Tigers is an advisory panel and not adversarial in nature.

The Big Ban Lie

UN Secretary General Ban Ki Moon has misled the media and the public by giving the impression that the UNDP Regional Center situated in Sri Lanka had been closed as a result of the protest being carried out by Minister Wimal Weerawansa outside the UN country office in Colombo.

When contacted by Daily Mirror online today, a UN Colombo official clarified that preparations were underway for several months now to close down the UNDP Regional Center in Sri Lanka and it was not linked with Weerawansa’s protest.

However in a misleading short statement released by the Secretary General at the UN Headquarters in New York yesterday, Ban Ki Moon had said he had decided to close down the UNDP Regional Centre in Colombo and was recalling the United Nations Resident Coordinator, Neil Buhne to New York for consultations.

However the UN Chief had failed to mention that the closing down of the UNDP Regional office had no connection what so ever to Weerawansa’s protest resulting in major news organizations and international wire services reporting that the UNDP office had been closed as a result of the tensions outside the UN Country office in Colombo.

When asked to clarify the connection between the UNDP Regional Center being closed, Neil Buhne being recalled and Weerawansa’s protest, a UN Colombo official said that all UN offices were continuing to function as normal and the shutting down of the UNDP Regional office had nothing to do with the ongoing issue outside the UN Country office in Colombo.

“To my knowledge it (closing the UNDP Regional Center) has nothing to do with this current issue because it has been on the cards for several months. It is not a new move. This UNDP Regional Center was located earlier in Kathmandu but because of the worsening security situation their during that time, the decision was taken to shift the Center to Colombo somewhere in 2006 or 2007. However within the last year a decision was taken, taking into consideration some administrative and financial concerns to downsize the regional center and to shift the main functions back to the Bangkok office. This is not a new move as it has been on the card for several months,” a UN Colombo official explained.

The UN Secretary General by releasing a single statement regarding the UNDP office, Weerawansa’s protest and recalling Neil Buhne for consultations seems to have attempted to give the impression that he was giving a firm response not just by word but by action to show his anger towards the government’s failure to prevent the heated protests outside the UN Country Office in Colombo. A new Tamil political party forum formed in Sri Lanka

July 09, Colombo: Nine Tamil political parties that support the Sri Lankan government have joined to form a new Tamil political party forum in Sri Lanka.

However, Sri Lanka's major Tamil constituency Tamil National Alliance (TNA) is not part of the newly formed forum.

The parties in the alliance are the Ealam People's Democratic Party (EPDP) led by Minister Douglas Devananda, Tamil People's Liberation Tigers (TMVP) led by Eastern Provincial Council Chief Minister Sivanesathurai Chandrakanthan, Eelam People's Revolutionary Liberation Front (EPRLF) led by former Chief Minister Wardharaja Perumal, Tamil United Liberation Front (TULF) led by Ananda Sangaree and People's Liberation Organization of Tamil Ealam (PLOTE) led by D. Siddarthan.

No war crimes committed in Sri Lanka - SF

Former Army Commander and DNA Leader General Sarath Fonseka yesterday vehemently denied the allegations that war crimes had been committed during the last stages of the military operations in the Vanni. He said that had war crimes been committed in Sri Lanka, he would have been the first person to get into trouble.

He was answering queries by journalists about government’s allegations that he (Fonseka) was planning to give evidence before a UN experts panel set up to investigate war crimes in Sri Lanka.

"I have consistently maintained that the war was conducted according to internationally accepted norms. No war crimes were committed," he told a press conference at the Parliamentary complex.

He said that there were jokers who had spoken yesterday as if they had conducted the war.

"I take the full responsibility for all what happened during the war," the former Army Commander said.

He said that the some government-backed jokers were misinterpreting and giving twists to the appointment of an advisory panel by the UN Secretary General to advise him on the accountability during the last phase of the war against the LTTE.

I don't entirely agree with the economic prescriptions for Sri Lanka of this thought provoking article. Some comparisons with other nations .. particularly the Western Lesson, and the analysis of the "beneficial impact" of US monetary policy are not entirely correct. China, for example, is today judiciously investing its EARNINGS hoarded at great cost to its people over many decades of doing without, not its borrowings.

In my mind, borrowing for investment in judiciously selected long-term infrastructure development is OK, but borrowing for short term consumption is not. Each of this author's proposals have to be evaluated within that broad framework.

With Sri Lanka vanquishing terrorism from its borders, President Mahinda Rajapaksa and his armed forces have hitherto done something which no other country has achieved for a long time. All countries experience terrorism in one form or another and no country is exempt from this scourge. Unfortunately innocent civilians become potential targets and victims of terrorist agendas. On the other hand, the state could also discriminate and take action against a group of people to force them to join the governmentagenda —at any rate, both these actions result in civil liberties and human rights being attacked and compromised.

The superpowers are ironically the greatest threat to civil liberties and human right abuses all over the world. Yet they focus on human right violations in countries such as Sri Lanka as a tool to gain the upper hand over such nations. Today, Russia and China might defend themselves against anti-government forces within and across borders while American and British forces fight in Iraq and Afghanistan. But the world is silent when they do it. Sri Lanka braves the Western world and eradicates terrorism militarily. Do Western countries, with their past histories and present record of atrocities committed, have a right to dictate such terms to Sri Lanka?

Human rights and civil liberties need to be fixed with priority but Sri Lanka will do them amidst other priorities as well. After the military success over the LTTE, President Madinda Rajapaksa requires to focus his urgent attention on the economy. We cannot waste time. This is because with prosperity comes equality in which the disparities among communities will become less and less. If all the people among this single nation were to become affluent with little or no competition for resources, amidst increasing freedom of movement and exchange of trade, the ethnic problem will become more tractable. An affluent population would engender tolerance for different ideologies, a love for and an appreciation of different arts and cultures, and this could ultimately promote the spiritual wellbeing of the people.

Sri Lanka has a wealth of resources at its disposal. Although it does not possess natural resources in tangible form it does posses them, however, with the 20million people at its disposal to carry out its future plans. Strong leadership along with a certain degree of boldness and singled-minded purpose will drive the population to harness the resources available in the world today and make Sri Lanka another example of undiminished economic success. The current administration has the capacity and the boldness to prove to the rest of the world that Sri Lanka indeed can become the "pearl" of the Indian Ocean.

Experts from all corners of the world, and especially within the quarters of the opposition, would say that sovereigns such as Sri Lanka must not borrow too much. Borrowing has been likened to a millstone around one’s neck whose weight neither this generation nor future generations could bear. Today, we may ask the most important question, which is the country that borrows the most and is the strongest in the world. America is the world’s biggest debtor but the whole world is indebted to it!

US has one obvious advantage, which neither tiny Sri Lanka nor even the consolidated power of the EU possess. US is the single most important reserve currency (61%) of the world. With its fiat stamped upon a majority of international trades and contracts such trades being executed in US dollars, the US can issue paper or electronic money and buy anything and everything the world has. This is facilitated because other countries store their surplus wealth by buying US treasuries and assets. The unique feature of the reserve currency status is that whatever the US buys, notwithstanding the quantum of money outside its borders, it never lessens or takes away from the American economy but aggrandizes it. The only thing that stacks up is its public debts.

They can feed their 761 US military bases across 156 countries with no effort on their part. If the Americans have a military base in Japan, the Japanese will feed them using their own resources. The host country of the US bases will provide food, clothing and shelter and the America will pay in US dollars. Japanese will then deposit this money with a Japanese bank whose counterparty or correspondent bank may be another US or a Japanese bank domiciled on US territory. What is the underlying transaction? The US government has issued nothing but paper money – cheques for millions of US dollars – and thereby fed its army. The Americans have got real value out of this arrangement but the Japanese will have real value only when they decide to spend the US dollars.

The Japanese may now decide to buy goods and services from China, since importing Chinese items may be cheaper than getting them from the US. The Chinese will expend their own resources and export goods to Japan. As the US currency is one of the major currencies to be used in execution and exchange of trade transactions (another advantage) Japan will use US dollars to pay for the bill. The Chinese will bank the US dollars like the Japanese did in the first instance. Has the US gained from the second transaction between Japan and China? Of course, its currency has become global fiat. Moreover, when the US decides to trade with any country it is never subject to exchange rate variances; the rest of the world, however, is!

The American trade deficit in extremely high compared to the rest of the world while China is in surplus —almost 1 trillion US dollars in 2010. Recently, China declared to the US, "We own you!" Actually, the Americans need to borrow 2 billion US dollars per day to uphold and upkeep their way of life. This is exactly how the Americans do business with Asia and the rest of the world. In 1835 the US public debt was zero. After the financial crisis in November 2008, US foreign and domestic debt level (public debt) has almost increased significantly to 89 percent of its 13 trillion dollar economy. Does anyone complain? Does anyone worry about its ability to repay debts?

BORROWING OPTIONS

For Sri Lanka to re-consider its borrowing appetite, assessing its debt repayment capacity is imperative for further borrowings. The US example shows otherwise. However, Sri Lanka’s balance sheet and revenue generation capabilities must be enhanced by every cent of foreign money borrowed. The IMF and unfortunately the opposition both have similar understandings about foreign debt. The IMF will stipulate that Sri Lanka needs good fiscal discipline to secure its standby arrangement and support package and they will enforce it at whatever cost. They will praise countries in Asia and sub-Saharan-African nations which do not borrow from other countries for exercising such fiscal discipline and for tightening their belts. IMF and World Bank will grant such countries small concessions as incentives and sweeteners to ensure that poor countries will stay poor. The biggest beneficiaries are Western Corporations and multinational companies that do business with poorer countries and profit from them.

In addition to the US, Britain, EU, Japan and now Australia have the property of their currency being a world reserve currency. Exchange rates of the home currency are primarily affected by lower stock of foreign currency reserves —following greater value of imports as opposed to exports, which is one reason for the Sri Lanka rupee to depreciate since independence. This is because trading currencies are limited to a basket of major currencies such as USD, GBP, EUR, JPY CAD, CHF. AUD, SEK and NYZ while most other currencies are inextricable pegged to the US dollar. China, it may be said is an exception to this rule. Due to the supply of cheap labour and its vast resource base US and Western companies have invested large sums of money and set up manufacturing plants and facilities in China. China has so far used a strategy of artificially keeping is currency lower to gain access into larger US markets defying and undercutting other Asian exporting countries. China has indeed succeeded. But we are not China and our resources are comparatively limited.

WESTERN LESSON

We must therefore learn from the West and there is one important remedy underpinning all this —we must improve our flagging balance sheet. Our assets are dilapidated, outdated and hardly fit for revenue generation. Look at our roads, energy supply, housing, cars, agro-base, transport systems, education and we can see that we are lagging far behind other nations. Our housing is limited and our buildings old. Sri Lanka’s fleet of vehicles is virtually the backyard for unwanted Japanese vehicles. In this light, SL’s balance sheet needs to be upgraded rapidly. How must we start? We have no capital resource such as oil or commodities such as gold, silver, iron, and palladium. Yet we can borrow, borrow and borrow and use this pool of funds to fast-track infrastructure development and upgrade Sri Lanka’s balance sheet. Fortunately, this is currently taking effect thanks to this farsighted infrastructure strategy in place by the incumbent government.

Sri Lanka’s debt servicing capability is unblemished. We must maintain this at any costs and there are two ways we can yet do this despite increasing foreign and domestic debt levels. It is known that if the Central Bank holds foreign currency and deploys LKRs into the market it could causes inflationary pressures. Yet this can be avoided by allowing local companies to hold and use foreign currencies to pay for and settle their debts. A freely convertible exchange policy is therefore essential subject to an interest rate policy. The flip side, of course, is that we will expose ourselves to unscrupulous foreign exchange speculators in the likes of George Soros to punish such countries by using his wealth. Today, Malaysia has not forgotten what he did to them in 1997 which sealed the Asian financial crisis.

Nonetheless, when our infrastructure gets a boost we can borrow more to repay debts and/or we must galvanize the economy to such an extent that we generate massive export revenues from the exchange of goods and services. We need to start by slashing all duties on consumables and investment goods to zero and make SL the world’s No. 1 tourist and duty-free destination. If we do so, our economy will emulate those of Singapore, Dubai and Hong Kong and we can do it better. We can learn from the pains that those economies underwent during their transformative stages. If the unshackling of all duties is initiated that could have foolish consequences if there is no proper economic plan and vigorous monitoring system in place. Our domestic industries will become uncompetitive overnight and Sri Lanka’s trade deficit would balloon. Subsidies for the agro-based economy would need to continue through this borrowing regime until such a time the economy matures. If we borrow considerably and have significant reserves of foreign currency drawing rights in store the transition could become seamless.

Thereafter, it must become mandatory by an act of law that that all shops in Colombo and in urban cities must be kept opened till 10.00 P.M. Bold business leaders must take the lead. When our shops are filled with the best of all the branded goods, which should be cheaper than those of other Asian tourist destinations, there will naturally be an exponential influx of tourism in Sri Lanka. It would be a natural boon to the economy and Sri Lanka’s leisure sectors would boom. More and more shopping complex and trading centres will open and construction activities will take place to exploit the huge opportunities that will be thrown open by the flood of tourism and unprecedented exchange of trade.

Unemployment will be solved rapidly with more demand for semi-skilled personnel coming in from sophisticated shopping areas and precincts. Our rural folks will increasingly migrate to centres of prosperity when economic activities in those urban areas start expanding in the country. There should be "controlled" bars to entertainment and such areas could be carved out as it is done in Singapore. With the exchange of goods and services being the major focus of the economy, Sri Lanka’s tourism is bound to thrive. Government revenues will fundamentally come through taxes which these trading houses, shopping centres and 5 to 6 star superluxury hotels will earn. It is likely that tourists will pay more money for accommodation and for a world class experience if they can also buy top-of-the-range goods cheaper than what is available in their own countries.

In the age of information and technology are we bracing ourselves for a future we cannot predict and understand. The traditional values are unlikely to exist in their current form with Facebook now emerging as the new internet platform for social networking. What is better we may ask. Is it a weak economy with people chained by poverty, or reasonable affluence based on a robust economy to free them from enslavement to ideologies of antiquity? The state must not fear the critics since they are needed in any society to ensure that there are proper checks and balances in society —a disciplined and well paid police force is therefore vital.

This is our hour of reckoning. We need to be bold and we need not unnecessarily fear the consequence of borrowing too much. There is a significant difference when an individual or a corporate entity borrows as opposed to when a sovereign state borrows money. Individuals borrow for short term whereas government can borrow for 50 – 75 years. If we look at various countries that went through various crises such as Argentina and South East Asia or, now Europe – Greece, Portugal, Spain and Hungary – they all seem to be better off than Sri Lanka and after this financial crisis passes they too will come out of the woods looking yet better and stronger still. America has borrowed so much from everyone but there is still an implicit confidence in their economic power even though the American had triggered the worst financial woes since the great depression.

We must, of course, judiciously employ money that is borrowed for capital investment as well as for recurrent ones instead of politicians making do with most of it. The money we borrow must find its place somewhere in the country’s balance-sheet-upgrading exercise. Once Sri Lanka’s balance sheet improves and revenue account surges its sovereign rating will correspondingly improve. When this occurs we could raise sovereign or even corporate bonds from the international market and borrow at cheaper rates, and much more. After independence, how did the Singaporean dollar become an alternative trading currency in Asia while the LKR lags behind in the doldrums of obscurity? If we pursue this path of first importing all the best items of American, European and Asian goods, we will also one day be able to reproduce them locally. It is also right time to stop the exodus of the brain drain. President Mahinda Rajapaksa won the war; now he can implement these economic plans with resounding results.

Govt mulls end to primary exports

Treasury Secretary Dr. P. B. Jayasundera said the government was planning to put an end to the export of raw materials and products in their primary forms such as Tea, in a move that is not inconsistent with World Trade Organisation guidelines.

"We will soon put a stop to exports in their raw forms without value additions. This would not be a violation of WTO rules of trade, but an attempt at creating the economic base," Dr. Jayasundera said last morning addressing the IT/BPO industry chamber.

He said this would be an important step in creating meaningful employment opportunities.

"For a long time we were talking about tea, tea and tea. The industry exports tea in its primary form, employs unskilled workers and occupies half the land. It needs to diversify and create value added brands, only a few are doing this," he said.

Dr. Jayasundera said the one billion dollar industry had no scope for improving further unless it diversified and created value added brands. In contrast, the apparel sector had showed tremendous growth while creating value chains despite disturbances it has to face. Its domestic value addition is over 50 percent.

He said the government was committed to creating an enabling environment that would create ten industries that would earn US$ 1 billion by 2016. Raw material import duties were slashed recently in a bid to giving the manufacturing sector a boost.

True, this is the kind of diplomatic approach GSL should follow - even to keep fighting, without losing.

WW is unlikely to stop his fast (due to JVP genes, and giving another laugh for colombians.) But I think WW can serve better to our nation by living a day instead of dying. I think, MR should use force and hospitalize him in bad situation. This will too make colombian lot+JVP happier the other way but its not a problem, as long as WW is safe.

Sri Lanka's NFF Leader resigns from ministerial portfolio

July 09, Colombo: Sri Lanka�s National Freedom Front (NFF) Leader Wimal Weerawansa today (9) resigned from the ministerial portfolio of Housing, Construction and Engineering Services.

NFF sources confirmed to ColomboPage that the letter of resignation was handed in today morning and the President was also informed of the decision.

Weerawansa has stated in his letter of resignation that he would continue with the protest campaign against the UN panel of experts and did not wish to place the government in any difficulty due to his position as a Cabinet minister in the government.

However, sources say the President has refused to accept the Minister's resignation.

These 10 countries are double acting. They got Monkey Boon to appoint a panel and now they are playing the game. This is not a special situation for them, they are acting from both ends. Check their UN voting record in may -2009. They buy things from SL, not to support us but because they want to buy them, perhaps cheap. They will go elsewhere if our products are expensive. However, they shall never be allowed to muscle in to our democratic will and right to live peacefully. If they impose unilateral trade sanctions, we may get hit but we can survive. At the same time, when they themselves are hard pressed with economic problems, there aren't that many options for trade games.

July 09, Colombo: Sri Lanka's Ports and Aviation Ministry will purchase two sea planes from Canada this year in an effort to boost tourism industry in the country.

The Ministry, with the purchase of the sea planes, expects to promote inland air transportation for the convenience of local and foreign tourists.

A program is mooted to develop the inland airline service to contribute to the growing tourism sector. According to the program, several inland reservoirs and lakes around the country suitable for landing and taking off sea planes will be developed as ports.

Under the program, the Ministry plans to use 12 inland lakes and waterways including Beira Lake, Victoria reservoir, Tisa Wewa, Parakrama Samudraya as destinations. In addition a service from Negombo lagoon to various parts of the country has been planned.

How much, and how frequently you contribute is up to you. We will use Paypal to allow you to do that securely, but will not keep credit card numbers and charge on a per month basis.

Some people (including myself) have volunteered startup funds, while others have volunteered to pay periodically. Whatever you can afford .. even $10 .. we gratefully accept .. the spiprit and motivation behind it matter very much.

We also want to have sponsoring contributors who volunteer to match contributions by others, after initial startup, on a dollar-to-dollar basis up to a maximum amount specified by the sponsor. I have volunteered to be such a sponsor. This way for every dollar a contributor gives, the sponsor will give a dollar, and the fund will get two dollars total.

At this time, we are trying to get a quorum of ten contributors to startup the fund .. We have NINE now!

The Secretary-General believes the strong reaction to his establishment of a Panel of Experts on accountability in Sri Lanka is not warranted. The United Nations has consistently held that this Panel has been set up to advise the Secretary-General with regard to taking forward the objectives of the Joint Statement of 23rd May 2009. These objectives include the further fostering of reconciliation and related issues as well as reflecting the commitment by Sri Lanka to the promotion and protection of human rights and the importance of accountability in order to continue the strengthening of peace and development in that country. The United Nations recognizes that the responsibility in this regard is that of the Government of Sri Lanka. The Panel itself will advise on the modalities, applicable international standards and comparative experience relevant to an accountability process. It will be a resource available to assist the Government of Sri Lanka and the Commission on Lessons Learnt and Reconciliation in applying the international best practice in this regard.

In response to a previously asked question, the Spokesperson clarified that the panel was not tasked to investigate individual allegations of misconduct.

NEW DELHI, July 9: India has advised visiting Tamil National Alliance (TNA) parliamentarians to accept the current realities in Sri Lanka, to be pragmatic, to move on, and work sincerely with President Mahinda Rajapaksa’s government to find an enduring political solution to the ethnic problem.

A six-member TNA team led by R. Sampanthan arrived here on Sunday evening, met several top Indian leaders, called on Prime Minister Dr Manmohan Singh on Thursday, and flew back to Colombo tonight.

TNA MP Appadorai Vinayagamoorthy told The Island this afternoon: "We are thoroughly satisfied with our visit to India, and with our talks with the leaders and officials here."

"The Indian government has assured us that it will work along with the TNA. Fourteen of the 18 MPs elected from the Northern and Eastern provinces belong to TNA. We are the true representatives of the Tamil people," he asserted.

The TNA MP said: "We depend hundred per cent on India for help to find a political solution acceptable to our people. We will be happy if President Mahinda Rajapaksa gives us what India thinks is reasonable."

Vinayagamoorthy said: "Prime Minister Dr Singh advised us to take along with us the Muslims, the upcountry Tamils and others and work unitedly with President Rajapaksa to evolve a solution to the Tamil problem. We told him we will try to do so."

Apart from meeting Dr Singh, the TNA team called on External Affairs Minister SM Krishna, Home Minister Palaniappan Chidambaram, Finance Minister Pranab Mukherjee and met Foreign Secretary Mrs Nirupama Rao.

Sri Lankan High Commissioner to India Prasad Kariyawasam hosted a dinner for the team. Appreciating the gesture, the MPs told the envoy: "We are honoured to be invited by you. We are happy to attend your dinner as Sri Lankan parliamentarians."

This is perhaps for the first time that the Sri Lankan high commissioner here hosted a dinner for MPs from the North and East ever since the LTTE began its bloody campaign for Eelam, a separate state for the island’s minority Tamils, in 1983.

The Island understands from people who interacted with the TNA MPs that, in the wake of the LTTE’s defeat in the so-called Eelam War IV in May last year, President Rajapaksa’s impressive re-election for a second term, and the near two-third majority that his coalition garnered in the parliamentary election early this year, the visitors appeared to be coming to terms, slowly but definitely, with the changed political realities in Sri Lanka today.

One such source told The Island: "The Indians advised them to get real and drop the rhetoric and the mindset of the 1970s and 1980s. The Sri Lanka of today is very different from what it was three decades ago. Instead of fighting amongst themselves, the island’s Tamils should now unite and negotiate a pragmatic deal with President Rajapaksa. They should work with this President because he appears to be making a sincere effort to solve the ethnic problem for good."

Another source said the delegation conveyed to the Indians their three main concerns, namely:

1. The high-security zones in Jaffna should be cut considerably if they cannot be dismantled completely;

2. The rehabilitation and resettlement efforts should be speeded up so that the internally displaced Tamils can go back to their original homes and resume their normal lives; and

3. The extensive presence of the all-Sinhala army in the Jaffna peninsula should be reduced drastically if it cannot be removed completely.

The Tamil MPs’ Indian interlocutors and the Sri Lankan diplomats they interacted with have assured them that the Rajapaksa government is taking suitable steps to address these concerns.

The other four members of the delegation are: Selvam Adaikalanathan, Mavai Senathiraja, M. A. Sumandhiran and Suresh Premachandran.

Plenty of protests at other Embassies/locations have held up staff. Exactly how does it “stop them” doing their “vital work” (what fucking work do they do anyway? ABORTION FOR ANY OTHER REASON SHOULD BE PROSECUTED AS MURDER.

Unwanted newborns should be accepted by any police station, no questions asked, and put up for for adoption by private citizens, or failing that, by the State.

Massacre of the innocents: 1,000 abortions daily

In a shocking disclosure, which amounts to a massacre of the innocents, illegal abortion centers that have sprung up all over the country are alleged to be carrying out more than 1,000 abortions daily, a survey has revealed.

According to Health Education Bureau Media Unit Chief Dr. Shantha Hettiarachchi the survey conducted last year said about 3,000 illegal abortion centers were operating in Sri Lanka. “We are unable to arrive at an accurate figure because of the manner in which these undercover clinics are operating. The actual number could be higher than this,” he said.

Dr. Hettiarachchi said the statistics have also revealed that married and unmarried women underwent these illegal abortions.

He said a range of socio-economic reasons had resulted in this situation.

“Mostly it’s due to the lack of awareness on sexual health. In the case of married women this is a result of economic issues faced by them as well as the lack of a proper family planning methods,” Dr. Hettiarachchi said.

No doubt it was not just the serpent who was behind this move. I never meant it was just him. But he is the one who really gave that energy boost to the whole war crimes club –including the scum within our country. He gave what these bastards who wanted the war crimes bs what they were desperately looking for, an “inside source”.

That DOG Ranil was so demoralised and almost out (I know he is a sakkillya and would never give up, but I hope you know what I mean) then this Gonseka crawled out of his hole and gave such energy and hope.

I am stunned at the number of comments on places like Adaderana and DailyMirror attacking. Such vile hate for Wimal, just shows how averse the Colombians are to nationalism and how frustrated they are. These people REVEL in “misery” brought to Sri Lanka by their masters.


But seems Ranilam and para suddha are mostly done with Gonseka. They got what they wanted out of that fool (his ugly mouth, election avoiding for Ranil) and now they IGNORE him and what he has to say. I am sure if he levels another damning set of lies or challenges Sri Lankas existence again they will quickly quote him, then ditch him again.

Anyway i agree, Ranil is the biggest manipulative treacherous scum there is. He thinks he is being "real smart" by "pulling of " con games like this. Years ago a UNPer who switched to the SLFP said how Ranil engineered a fight between two people in Parliament then went to some room and watched it on TV and laughed how he got them to tare themselves apart, where the only winner would be him. He thinks his Machiavellianism bs is super clever.

In Korea "being white" is seen as being "superior" and they are increasingly abandoning their own heritage and culture to be "more white". Suppose 50 years of occupation has done that creating what is a SLAVE nation. That is the exact fate waiting for SL if Colombians seize power again, it is what Ranil started doing when he briefly held power. So it understandable they can produce a bunch of sniffling scum like Ban.

Anyway I would rather be on the safe side.

Now for some facts:

Cost of living is an issue that has been heavily exaggerated and exapserated by the UNP.

As for KP, LOL. Ranil sounds upset this guy was caught and jailed and wants him out –it did disrupt reorganising the LTTE and perpetuating conflict in Sri Lanka so does make sense Ranil is “out raged” by his capture (did Ranil ever try to stop KP and get him arrested? Oh that’s right the UNP went around supporting the LTTE and wanted our own Army destroyed instead). Amazing how they sustain themselves on their own propaganda they themselves create (about KP and CoL). Does the UNP/Colombians/Ranil think the people are stupid to forget how they ran the country in 2002-04 and what they did against the country since 2005 onwards?

Lets not forget Ranil kept on phoning the hospital Fonseka was in back 2006 desperately begging to know if Fonseka was dead yet and cursing when he found out he was alive (when news came that Fonseka was going to Singapore he used his contacts with the LTTE to try and get KP to kill Fonseka en route or in Singapore). Then there is calling for Fonsekas removal in 2007 after the first LTTE air “attack” followed by sending a letter to the Air Force commander “congratulating him” on ending the war, ignoring the Army and Navy. And of course there was trying to have Fonseka and the whole army dragged away to his masters kangaroo courts when the “option” of the LTTE killing him became less and less likely. We all know Ranil HATES Fonseka but is championing him on three counts: 1. To get votes and make it look like he cares, 2. Fonseka’s release means Fonseka can open his foul revenge filled mouth about “war crimes” which he (Ranil) wants to use against the country to bring isolation and economic sanctions thus ruin the lives of ordinary people as he has attempted these last few years “cleverly” thinking the people will blame the Government for the hardships the UNP creates thus giving him an avenue to come to power (which also exposes his bogus concerns about the cost of living) and 3. Divert attention from challenges to his UNP leadership.

Finally if he cares so much about Fonseka why did he refuse to give Fonseka UNP party leadership/retain the PE alliance for the GE? Which was causing huge arguments and problems for Ranil prior to Fonsekas arrest (his arrest did Ranil a massive favour and Ranil knows it). Why did Ranil at least ceremonially not give leadership to Fonny (once Fonny was in jail), or retain the alliance ceremonially? Fact is Ranil wants power and will do anything to get it even if that means an LTTE victory, our own Army defeated and destroyed, our soldiers dragged away to the kangaroo courts of the West or the disintegration of the very State itself, along with economic sanctions, misery for the people (the last two he enjoys a lot because he hates the people). Power at all costs, that is the Colombian way. Too BAD it will never work.

Yes, I know about the conversion of South Korean Buddhists to Christians by American Evangelists, and that today Koreans themselves are more aggressive in converting than Americans. I am saddened by that .. but that is the choice the Koreans made in their own country.

If Koreans don't care about their heritage and Buddhism, who are we to blame them? Let them look after their business .. and we will look after ours. Since we care for our heritage and Buddhism .. let us protect them, without discrimination against other people and religions.

Given that in the short space of 50 years after a very destructive war they have made their country grow into a first-rate economic and industrial power .. we have a few things to learn from them, irrespective of their abandonment of their original religion.

If we take care of our people without letting them turn to misssionaries for handouts, prevent foreign missionaries from exploiting our poor people, give our people a reason to value our heritage and religion, protect our borders so that our majority status is not compromised by unrestricted illegal immigration, Sri Lanka will remain the beacon of Theravada Buddhism, and Sinhela culture, it has always been. We can achieve prosperity for all of our people, without abandoning our heritage and religion that give our lives meaning.

Attributing Ban Ki Moon's self-serving antics, perhaps to get appointed to a second term by the powers that call the shots at the UN, to defects in his South Korean heritage and/or religion is just plain wrong.

Let us blame the specific wrongdoer, not all people of his race and religion.

South Korea is an important trading partner and aid donor for Sri Lanka; let us not demonize them also.

Let us look more towards learning from the mistakes and successes of others, rectifying our own defects, and protecting our country more wisely than we have in the past, than resorting to blaming every foreign nation for our deficiencies.

However angry we are with Ban Ki Moon, we must be rational and balanced in our responses: Blame the WRONGDOER, not entire communities of innocent people.

Kang Cheol-Hwan, North Korean defector and activist, thinks Kim Jong Il’s brutal North Korean regime will collapse within three years, five years at the most. But the prospect doesn’t make him giddy. On the contrary, the imminent fall of the one of the world’s most repressive states just means more work. However much he wants North and South Korea to be reunified, he knows that how it happens is as important as reunification itself.

“If it’s done wrong, it will fail,” Kang told me last week when he was in town to attend a conference on the fate of the North Korean regime. As founding director of the North Korea Strategy Center, a non-profit in Seoul, Kang works to prepare North Korean defectors for leadership roles after reunification. But in many ways, he works just as hard to prepare South Koreans — and even Korean Americans — for the inevitability of a unified Korea. And its discontents.

We’ve seen it again and again: Once the dancing in the street is done, even a devoutly to-be-wished-for political revolution is as much pain as progress. Humans don’t make the leap from one political system to another with ease. We aren’t as good at any of it — democracy, freedom, change — as our politicians, myths and theories would lead you to believe.

The coda to Kang’s 10 gruelling years in a North Korean labour camp is the disillusionment of freedom. In 1992, at the news conference announcing his defection, he encountered a sceptical press corps: Was he being used by the South Korean government? Journalists ‘who had lived their whole lives swaddled in perfect comfort, were looking down their noses’, he wrote in his memoir, The Aquariums of Pyongyang.

Eighteen years later, Kang’s resentment still flares. He suspects South Koreans are too wrapped up in their search for wealth and status to even understand the horrors of the North Korean regime. Not only does he feel they lack ‘the internal courage to see the essence of evil’, but Kang doubts the South Korean public’s genuine desire for reunification.

Kang says he likes talking to Korean American audiences in part because he finds them more sympathetic to his cause than South Koreans. South Koreans would rather not think about the hardships in the North. Not only do a lot of Korean Americans have roots in the North, but, he says, “they are further away and are nostalgic for the homeland”.

Not surprisingly, Kang seeks to counter fear of unification and anti-Northern prejudice by talking up the growth of North Korea’s market economy. After the failure of its state-controlled economy in the 1990s — and devastating famine in 1996, the Dear Leader has been unable to prevent a flood of private citizens from starting businesses. According to a recent study from the Peterson Institute for International Economics in Washington, almost half of North Koreans now receive all of their income from the private sector.

It’s this fact that gives Kang hope that Korean reunification would go more smoothly than it went for the Germans. Kang thinks East Germans weren’t prepared for a market economy, and on top of that, they didn’t have much say in how reunification was achieved. Nascent capitalism in the North, and his efforts in the South, could change that.

Kang and his work represent a sobering, de-romanticised one-Korea future, but even he can’t suppress the hope inherent in his goals. I asked Kang how many years it would take for a reunified Korea to truly become one country. Fifteen, he answered. I hate to say it, but I think he may have to suffer one more wave of disillusionment.

The US pumped in billions upon billions to turn them into a first world country economically (at the cost of their heritage and independence) and made them a slave nation (of the mind) to stop them from falling under Communism and to be a tool to control North Korea, and Red China.

Heck they would do the same for us if we choose to be slaves like Colombians. They would in fact be fighting to protect us in that case.

Our Buddhist heritage is who and what we are, there is no point in having a country or even existing as a people if we throw all that away.

They are creating TE because they know the strength of our heritage is to strong at the moment, and so will go for already willing slaves. They target Buddhist monks (all ways demonising them) because they know it is them who have historically protected Buddhism and the Buddhist people + heritage of this Island. They always make a point of Christianising this country.

South Korea ARE SELL OUTs.

Yes, I agree that there is an element of truth in that: Sinhala culture is tolerant and welcoming, and is often exploited.

However, there is another reason for certain Tamils calling us "modayas".

The British favored them in the colonial administration .. as a means of suppressing majority communities with minorities that they practised in all of their colonies everywhere in the world. The application of this policy to the Sinhala people over 150 years, created among Tamils a notion that they were Superior Highly Intelligent folks .. by birth.

This notion of intrinsic racial superiority, that did not exist in pre-British colonial times when the Sinhalese ruled, contributed to separatist demands, and persisted until 2009, when it was well and truly demolished by the much despised "modayas" on the banks of the Nanthikandal Lagoon.

That is one of the MAJOR ACHIEVEMENTS of the Rajapaksa Government .. eradication of the automatic "modaya" insult for the Sinhalese from the Tamil lexicon.

As long as the memory of that VICTORY by the "modayas" persists in Eelamist minds, the word "modaya" is unlikely to be applied broadly to describe Sinhala people.

It is up to us patriots, to ENSURE that this image REMAINS VIVIDLY ETCHED in the deepest recesses of Eelamist minds.

The US pumped in war relief funds into South Korea after the war, just as the US pumped money into war-torn Europe under the Marshall plan.

However, it was nowhere in the amounts needed to transform South Korea into the economic/industrial miracle it is today. Certainly, the US did not pump money into Soth Korea in, or after, the 1980's. Can you prove that statement with references?

Even in the 80's South Korea was referred to as an "Asian Tiger" .. together with Hong Kong, Singapore and Taiwan.

The economic power South Korea is today .. they achieved largely through their own brilliance, and aptitude for hard work .. just like the Japanese in post-war Japan.

I read it a long time ago in a topic regarding the US Christianising South Korea around 2002 i believe.

It was part of assisting Korea in developing through the 60s and into the 70s. Korea was never politically stable as it was never democratic with repressive regimes in power while the US wanted to keep the nation/people "happy" through economic upliftment to prevent communist infiltration.

I am not denying their hard work and establishing famous companies, but they had a lot of assistance in more ways than one.

Is United Nations Secretary General Ban Ki-moon trying to squelch a branch of the world organization whose string of recent reports have drawn member nations' attention to dramatic U.N. failings?

At a closed-door meeting of U.N. diplomats earlier this week, the Geneva-based U.N. investigative group known as the Joint Inspection Unit, whose job is to assess and improve the efficiency and coordination of the U.N. worldwide, issued a highly charged annual report that raised the question.

Buried in the middle of the 52-page document came a remarkably blunt accusation from the JIU's inspectors that Ban had abruptly and secretively changed 40 years of accepted procedure for selecting the JIU's executive secretary — a post, the report sharply noted, that has been vacant for 14 months.

The report added that a Ban-appointed panel had taken the "illegal action" of demanding a bigger hand in the selection of candidates for the job who had already been approved by JIU — a demand in violation, the inspectors said, of U.N. rules and regulations. The report urged the U.N. General Assembly to support the inspection unit and make Ban back down.

In closing, the inspectors, whose prose is normally a model of bland discretion, took a further undiplomatic pot-shot shot at Ban.

"The Unit," they said, "deeply regrets that the Secretary-General, as the Chief Administrative Officer of the United Nations, and thus in charge of promoting accountability as a key element for good management, has not yet taken any action to remedy this uncomfortable situation that negatively affects the operations of the Unit."

In a terse reply to questions from FOX News about the report, a spokesman for Ban would say only that "the Secretary General has followed all rules and procedures established in accordance with the statute of the JIU, the staff regulations and rules and relevant General Assembly resolutions."

JIU officials contacted by FOX News declined to discuss the report.

Behind the arcane procedural dispute, a significant power struggle was apparently taking place at the U.N.

On one side was the bulk of the U.N. bureaucracy, headed by Ban, which runs the administrative side of JIU's operations through its secretariat, but has no direct say over its reports. In the inspectors' view, that U.N. bureaucracy is now showing signs of wanting to take over the role of evaluating its own performance through what the inspectors call a "new United Nations evaluation entity," part of a recently formed "United Nations Evaluation Group."

On the other side was the tiny group of inspectors, usually financial and administrative experts with deep experience in the U.N. system, who are elected for two-year terms by the U.N.'s member nations — a measure of their importance — and report to the U.N. General Assembly, even though they depend on Ban's Secretariat for financing and administrative support.

The JIU reports are considered an important element of the General Assembly's control over the bureaucracy, though they have not, until recently, received widespread public attention.

And in their report, the inspectors charge that aside from impinging on their administrative autonomy, Ban's bureaucracy is now apparently out to supplant them.

As they put it in a tightly worded paragraph on page 18 of the report: "The Unit made public its position that there was no need to replicate structures that already existed within the system and that the Joint Inspection Unit has the mandate, independence and experience to meet system-wide evaluation needs, lacking only sufficient resources to properly discharge this function."

(The latter comment was an apparent reference to the fact that, as the inspectors put it, their $6.2 million budget has not increased in 20 years. In the report, they ask for a $400,000-a-year increase in 2010 and 2011, and promise to balance that with a 45 percent increase in reporting output.)

What makes the JIU unique is that the unit does not report to Ban and the other top bureaucrats of the world organization, but to the U.N. General Assembly, the 192 member nations that ostensibly supervise U.N. actions — but mostly leave the job to bureaucrats.

The JIU, in other words, is one of the few watchdog elements in the U.N. bureaucracy that is not under the control of the bureaucrats it is intended to scrutinize.

As "external" and independent experts, the JIU inspectors — there are only eleven — are, in fact, the only knowledgeable overseers with a independent mandate to evaluate the U.N.'s hodge-podge of some 35 funds, programs and organizations world-wide. Their responsibility lies with the U.N.'s "owners" rather than its managers. And their recent evaluations of U.N. operations and management have been scathing.

Among them:

• In December, a JIU note to top managers in uncharacteristically blunt terms declared that the U.N.'s $10 billion procurement business — the buying and selling of goods and services for its operations worldwide — was a shambles, in which procedures were not followed, documentation was often missing, and the total amount being spent on corporate consultants was unknown.

• Another JIU report to the General Assembly issued last December warned that the United Nations' management of all worldwide treaties and programs for environmental protection was approaching chaos, while "sustainable development" agencies were getting the lion's share of new funds. Once again, the inspectors reported that U.N. agencies were unable event to tell how much money the U.N. is spending on managing its environmental actions.

• Yet another JIU investigation, which was forwarded to the General Assembly in November 2008, found that regional offices of the World Meteorological Organization, touted as key units in the growing array of U.N. tools to fight "climate change," were of "questionable" value, while the organizations' entire strategic planning system and internal budget procedures were a mess.

• A JIU report issued last summer found that a helter-skelter network of U.N. "liaison" offices around the world have taken on increasing important in U.N. internal communication, even though they suffered from lack of oversight, sometimes bizarre staffing policies, "known cases of serious mismanagement," without spelling out details.

Not by coincidence, the spate of critical reports about the quality and output of U.N. management comes at a time when the bureaucracy that carries out the work of world-wide hodge-podge of some 35 U.N. funds programs and organizations, plus Ban's Secretariat, is actively centralizing itself, and spreading its authority further than ever before in history.

Among other things, along with its previous peacekeeping and anti-poverty roles, the U.N. is seeking expanded world-wide roles in such areas as environmental regulation, "sustainable development," "climate change," global "food security," and planetary water and energy management.

It is also demanding that the world dig deeper into its collective wallet to pay for all those expanded efforts, most recently in the form of a $750 billion "Green New Deal" to revive the world economy, being touted anew this week by the United Nations Environment Program prior to a G-20 summit of world leaders in London on April 2..

The fact that the expansion is taking place on a global, or "system-wide" level is one reason that JIU reports have taken a more critical turn, as those "system-wide" efforts fall directly under the inspectors' mandate.

As it expands, meantime, the U.N. is creating a much more centralized bureaucratic shape, topped by a kind of central committee of top bureaucrats, chaired by Ban, and known as the Chief Executives Board for Coordination (CEB), which meets twice yearly to harmonize efforts across the entire U.N. system.

The CEB, composed of the top executives of the various U.N. funds, agencies and programs, has in the past few years spawned a further network of internal coordinating committees and networks in such areas as procurement, human resources and legal affairs.

One of those networks is the United Nations Evaluation Group, or UNEG, the focus of JIU inspectors' explicit concern in the annual report. Created in 2007 from an inter-agency working group with the same name, the network of evaluation within the U.N. bureaucracy declared from the outset, in an official paper delivered in April 2007, that it considered the JIU's inspection efforts were not "adequate as a system-wide evaluation function."

Composed of 43 U.N. member organizations, UNEG declared that it was going to build on a "common, U.N. system-wide set of norms and standards for evaluation." These norms and standards, "the paper declared, "are currently being adapted and used by U.N. system organizations as appropriate for their particular evaluation needs."

What makes UNEG different, however, are less its norms and standards than its governance. It is composed of organizations that report to the U.N.'s own top managers, rather than the General Assembly, with Secretary General Ban at the apex. The organizations themselves set the UNEG program, and its budget comes from the U.N. evaluation bureaucracies themselves. Members are explicitly told that formal voting on issues should be rare, and that consensus should prevail..

While UNEG has a chairman, to be elected from its membership every two years, its "Executive Coordinator," who will prepare budgets and coordinate work programs, is designated to be an employee of the United Nations Development Program (UNDP), the U.N.'s anti-poverty agency, which has increasingly taken the lead as the U.N.'s overall coordinator of development programs around the world. UNDP will pay the administrative costs of the evaluation group, and manage its website.

UNDP, as it happens, has had its own share of oversight scandals over the past few years, including a long and bruising battle with the Bush Administration over its programs in North Korea.

A lengthy independent panel report commissioned by UNDP showed last year that the agency had seriously violated its own rules and regulations in handing over foreign currency to the regime of Kim Jong-Il, even as North Korea exploded an illegal nuclear device.

The report also found that UNDP had flouted the U.N.'s own anti-proliferation sanctions against Kim by handing on to North Korea "dual-use" technology that could also be used for nuclear military programs.

The independent panel report showed no evidence that UNDP's internal evaluation experts had ever found weaknesses in the agency's payment and supply systems in North Korea, even though they involved violations of the most basic principles of financial accounting, as well as other U.N. procedures.

What is the definition of accountability? United Nations Secretary-General Ban Ki-moon may be about to find out.

Nearly a year ago Ban got a semi-public spanking from branches of the world organization that are supposed to oversee and fund his 22,000-person bureaucracy, including the 192-member General Assembly itself, for his proposals to reform the organization.

Now Ban is apparently back for more. The question is whether the result will be the same. The object of the institutional overseers' disdain a year ago was Ban's — in their view — less-than-impressive proposals to make the sclerotic and underperforming organization with a soaring budget, more efficient, effective and accountable.

They were contained in a turgid 53-page document entitled "Accountability framework, enterprise risk management and internal control framework and results-based management framework," which it turned out was not written in Ban's office but came from a management consultant firm, which was paid $1.8 million for the effort.

The General Assembly sent Ban and his consultants back to the drawing board and told him, in remarkably sharp prose, to try again. One thing that made the episode particularly painful for the South Korean secretary-general — for whom "face," or public respect, is especially important — is that some of the storm of criticism came from parts of the bureaucracy that report directly to him, as well as from the nation states that sign the checks.

And already this time, a key U.N oversight body, representing all the 192 countries in the General Assembly, has fired off a 13-page broadside, obtained by Fox News, which takes Ban to task for some new and old failings in his latest purported effort to shake up the system.

The views of the oversight institution known as the Advisory Committee on Budgetary and Administrative Questions (ACABQ) are important because they are usually adopted by the U.N.'s budgetary committee and by the General Assembly itself.

Among other things, the new ACABQ report says that:

• Ban still did not consult enough with the U.N. bodies that criticized his earlier efforts;
• Ignored some of the important recommendations made earlier to improve his reforms;
• Is still suggesting relatively toothless ways to make his top managers accountable for their actions;
• Has not established an effective system of internal controls for the U.N. bureaucracy; and
• Has not yet even provided an acceptable definition of what the word "accountability" means.

This time, however, the ACABQ stops short of a blanket rejection of all of Ban's efforts. Instead, it balks at some of them, snipes skeptically at others — especially Ban's bureaucratic proposals to reinforce "accountability" under whatever definition — and proposes further submissions by Ban to buttress his proposed changes.

"There is more work still to be done," says a Western diplomat familiar with the reform effort. "We are getting there, but slowly." Ban's efforts mean things were "getting better in some areas," he said. "And in others, not."

At issue is a 26-page document (with 39 pages of annexes) Ban submitted to the U.N. General Assembly for consideration this week entitled "Towards an accountability system in the United Nations Secretariat."

The tentative title on the document — implying that more negotiation lies ahead — is already a concession on Ban's part, and its first-person narrative is a signal that this set of proposals was actually written in his own office.

But this is the U.N., meaning that fluency, clarity and jargon-free coherence are still not the new document's strong suits — starting with an 85-word definition of accountability that includes the notion of the "obligation of the Organization and its staff members to be answerable for delivering specific results."

The same wordy definition, however, also includes the provisos that accountability depends on "a clear and transparent assignment of responsibility, subject to the availability of resources and the constraints posed by external factors" — a very sizeable trap door in an organization notorious for under-performing, over-spending and rarely if ever bringing punishment down on its top managers for their behavior.

Among other things, the ACABQ report points to that wording, which it says "may provide grounds for not holding the staff accountable under certain circumstances."

The overseers also note the "lack of reference to efficiency, effectiveness and timeliness" in Ban's definition, along with the omission of "personal responsibility for results." The ACABQ calls the "lack of clarity" in the definition to be one of the "fundamental weaknesses" in Ban's overall "accountability architecture," and suggests that a common definition of the term used by all U.N. bodies would be "desireable."

When it comes to making the U.N. focus on results, an area where all its internal critics agree it has been badly lacking, Ban admits candidly that a "chain of cause-and-effect relationships from inputs through outputs to outcomes" at the U.N. is "broken in several places."

Reverting to the U.N.'s customary opaque prose, he then says this "makes it impossible to advance the results-based management framework in a coherent and holistic manner and, at the same time, adversely affects the accountability framework of the Secretariat."

To fix that, Ban returns to an idea from his previously rejected proposals: yet another new mini-bureaucracy, nestled in the controller's office in the U.N.'s department of management. Ban calls it a Results Management Unit. (In his last attempt to outline reforms, Ban called it the Division for Accountability and Results Management.)

The Unit would have a variety of coordinating and monitoring roles, and would provide "training and guidance on the results-based management concept" across the U.N.'s sprawling area of departments and functions. It would also support a "network of results-based management/results-based budgeting practitioners across Ban's Secretariat."

All of this, Ban says, would be part of his attempt to change the entire culture of the bureaucracy — which he evidently agrees is not oriented toward a performance ethic that other organizations would consider basic and fundamental.

"I intend to promote a cultural change within the Organization," he asserts, "whereby staff understand that they will be held accountable for the quality and timely delivery of their work and supervisors understand they will be held accountable for effectively managing their staff towards that end."

"Training," he adds, "will be essential to effect this cultural change." He soon intends to announce a whole new set of management tools that will increase evaluation of managers, as well as "creative ways to reward, recognize and motivate staff and strengthen the remedies to address underperformance."

All of this comes atop a system Ban installed to sign contracts, known as "compacts," with his senior managers aimed at specifying their performance, which he also sees as a significant reform.

The ACABQ is only grudgingly impressed. While acknowledging the existence of the "compacts" the budget overseers note the "insufficient accountability awareness of all levels in the Secretariat," and says acidly that "thus far, the impact of the compacts on enhancing accountability at the United Nations has yet to be felt."

In the process of preparing its rejoinder to Ban's report, the committee also notes that it held a number of hearings with the Secretary General and complains that it "was not provided with adequate explanations ... as to the consequences stemming from mismanagement or wrongful or improper decisions." It wants more specifics from Ban as he defends his proposals before the General Assembly.
